法庭调解的文化根源:老传统、新传统与当代融合

【摘要】：本文并不局限于传统的历史分期,而是根据调解制度和相应历史发展以及社会历史文化发展之间的相互作用作为对调解历史的分期基础,将特定的社会历史文化基础与对应的调解制度进行分析,以便勾勒出调解的历史框架。
