论我国羁押必要性审查制度存在的问题及完善

【摘要】：羁押必要性审查制度作为刑事诉讼法中的新制度,近年来在司法实践和学术界引起广泛关注。构建完备的羁押必要性审查制度,保障刑事诉讼活动顺利进行,保障当事人人权,显得尤为重要。但是现行法律针对羁押必要性制度的规定过于原则化,操作性较差,比如何时启动羁押必要性审查、如何审查、审查方式、哪个部门进行审查、审查标准是什么等等问题,都需要明确,这样才能更好地让司法办案人员在执行纪要必要性审查过程中更有针对性和操作性,才能使羁押必要性审查制度不再流于形式,真正的发挥到维护当事人合法权益的作用。因此,本文着重从羁押必要性审查制度的意义、国内外羁押必要性审查制度的比较分析、我国羁押必要性审查制度构建的原则以及如何具体的构建我国的羁押必要性审查制度,如启动时间、启动方式、审查方式、审查标准等等进行了阐述和分析,以期对构建完备的羁押必要性审查制度提供理论参考和实践引导。
[Abstract]:As a new system in criminal procedure law, the examination system of necessity of detention has attracted extensive attention in judicial practice and academic circles in recent years. It is particularly important to construct a complete examination system for the necessity of detention, to ensure the smooth progress of criminal proceedings and to protect the human rights of the parties concerned. However, the provisions of the current law on the detention necessity system are too simple and operational, such as when to start the detention necessity review, how to review, which department to conduct the review, what are the examination standards, and so on. All need to be clear, so that the judicial case operators can be more targeted and operational in the process of carrying out the review of the necessity of the minutes, so that the examination system of the necessity of detention can no longer be formalized. Truly give full play to the role of safeguarding the legitimate rights and interests of the parties concerned. Therefore, this paper focuses on the significance of the examination system of the necessity of detention, the comparative analysis of the examination system of the necessity of detention at home and abroad, the principles of the examination system of the necessity of detention in our country and how to construct the examination system of the necessity of detention in our country. For example, the starting time, the starting mode, the examination standard and so on are expounded and analyzed, in order to provide theoretical reference and practical guidance for the construction of a complete examination system of the necessity of detention.
