中国林业行政公益诉讼制度构建

【摘要】:在阐述林业行政公益诉讼的概念、特征和作用的基础上,指出林业行政公益诉讼的原告资格应扩展至检察机关和社会组织,并对社会组织作出限制性规定;受案范围还应包括规章以下的抽象行政行为。对林业行政公益诉讼需要解决的具体问题包括诉前程序的设置、举证责任的分配、行政不作为的认定及其法律责任形式等进行深入分析。最后对林业行政公益诉讼立法提出了具体建议。
[Abstract]:On the basis of expounding the concept, characteristics and functions of forestry administrative public interest litigation, this paper points out that the plaintiff qualification of forestry administrative public interest litigation should be extended to procuratorial organs and social organizations, and make restrictive provisions on social organizations, and the scope of accepting cases should also include abstract administrative acts below regulations. This paper analyzes the specific problems to be solved in forestry administrative public interest litigation, including the establishment of pre-litigation procedure, the distribution of burden of proof, the identification of administrative omission and the form of legal liability. Finally, the paper puts forward some concrete suggestions on the legislation of forestry administrative public interest litigation.
