浅析《公民及政治权利国际公约》中arrest与我国逮捕制度的差异——兼议arrest的翻译

【摘要】：《公民及政治权利国际公约》现通行中文本中arrest对应的措辞为"逮捕"。对比《公约》下"arrest"的要求可知,无论是《公约》第9条"arrest"的适用范围、适用条件和程序还是错误逮捕的国家赔偿认定均有别于我国的逮捕制度。在坚持《公约》原则和精神的大前提下,矫正被异化的逮捕功能一方面要求"arrest"中文用语需符合《公约》的基本要求并建议将其译为"拘捕";另一方面要求秉持现代法治理念进一步完善非羁押性替代措施,严格提请逮捕的书面卷宗,调整逮捕审批阅卷方式,改变不合理的错误逮捕责任追究制度和评价机制。
