【摘要】：选举权是我国公民的一项基本政治权利,具有普遍性和平等性。选举权的保障程度既是衡量一个国家文明程度和民主程度的重要标志,是判断一个法治社会和宪政国家的重要标准。公民通过行使选举权来选择自己的利益代表人,参与国家管理,实现其当家作主的权利。我国宪法和选举法设立了诸多制度,有力地保障了公民的选举权。然而,随着我国社会主义市场经济的繁荣发展和城市化进程的加快,人口流动日益频繁,流动的规模也越来越大。我国政府采取了种种措施保障流动人口的经济权利、文化教育权利,取得了明显成效。然而,流动人口选举权的保障却一直没有受到国家和社会的重视。虽然,国家依法保障公民选举权的行使,但是由于“城乡二元结构”的制约以及选举法律制度的不完善,致使流动选民难以行使选举权。这种状况阻碍了我国民主政治的进程,影响了我国构建社会主义和谐社会目标的实现。因此,保障流动人口的选举权,维护流动人口的利益,对于我国建设社会主义政治文明,推进社会主义民主具有重要意义。本文对我国流动人口选举权保障进行初步探讨,希望从制度层面上对保障我国流动选民的选举权提出一些可操作性的建议。本文围绕流动人口选举权保障这一议题进行研究,共分为五个部分。第一章为绪论,第二章介绍了我国流动人口选举权保障的内涵以及保障流动人口选举权的重要意义。第三章介绍了我国流动人口保障的现状和存在的问题,包括立法状况和权利的行使状况。最后两个部分是文章的重点,第四部分对我国流动人口选举权保障不力的原因进行分析,涉及到现行的户籍制度,选举制度,经济原因,流动人口的自身原因等多个方面。第五章提出对策,针对第四章提出的问题和分析,一一提出解决对策。我国流动人口选举权的实现任重而道远,需要流动人口权利意识的提高,需要国家领导者的高度重视,需要社会学者和法学家追求民主法治的决心和恒心,需要全社会的关心和支持,但是我们应该坚信中国流动人口选举权的保障将会越来越完善。
[Abstract]:The right to vote is a basic political right of our citizens, which is universal and equal. The degree of guarantee of the right to vote is an important symbol of the degree of civilization and democracy of a country. Is an important criterion for judging a society ruled by law and a constitutional country. Citizens choose their own representatives of interests by exercising their right to vote, participate in the management of the country, and realize their right to be masters of their own country. Our Constitution and electoral law have established many systems. However, with the prosperity and development of our socialist market economy and the acceleration of the urbanization process, population mobility has become more and more frequent. Our government has taken various measures to guarantee the economic rights and cultural and educational rights of the floating population. However, Although the state guarantees the exercise of citizens' right to vote according to law, but because of the restriction of "dual structure between urban and rural areas" and the imperfection of the legal system of election, the protection of the right to vote of floating population has not been paid much attention to by the state and society. As a result, it is difficult for mobile voters to exercise their right to vote. This situation hinders the process of democratic politics in our country and affects the realization of the goal of building a harmonious socialist society in our country. Therefore, the right to vote of the floating population is guaranteed and the interests of the floating population are safeguarded. It is of great significance for our country to build socialist political civilization and promote socialist democracy. The author hopes to put forward some operable suggestions to protect the voting rights of floating voters in China from the system level. This paper focuses on the issue of the protection of the right to vote of the floating population, which is divided into five parts. Chapter one is the introduction. The second chapter introduces the connotation and significance of the guarantee of floating population's right to vote. The third chapter introduces the current situation and existing problems of the security of floating population in our country. The last two parts are the emphases of the article. The fourth part analyzes the reasons for the inadequate protection of the right to vote of the floating population in our country, which involves the current household registration system, the election system, and the economic reasons. The fifth chapter puts forward the countermeasures, aiming at the problems and analysis of the fourth chapter, and puts forward the solutions one by one. The realization of the right to vote of floating population in our country has a long way to go, which requires the improvement of the consciousness of the rights of the floating population, the attention of the leaders of the country, the determination and persistence of social scholars and jurists to pursue democracy and rule of law. We need the care and support of the whole society, but we should firmly believe that the guarantee of Chinese floating population voting rights will be more and more perfect.
