论权利的和谐价值

【摘要】:权利理论一直是中外法学界比较关注的问题。权利是一个始终变化和发展的主题,在长达三百年的时间里,权利的范围一直在拓展。从儿童,妇女,黑人,残疾人,到同性恋,越来的多的人们得到了他人的尊重,从政治和公民权利到经济、社会和文化权利,再到发展权,越来越多的权利得到法律的确认。在这种情况下,权利和谐价值的思想有助于引导人们和谐的配置权利与运作权利,从而保障权利能够和谐的发展。本文对于权利的和谐价值进行了研究,主要分为三个部分: 和谐作为权利价值有其必要性与可能性。和谐作为权利价值的必要性主要是从权利产生的条件以及不同历史时期,不同文化视角,不同认知水平下的人对于权利的解读,得出权利的含义。权利和谐价值是权利这一客体对人类自身、人与社会、个人与国家、人与自然等能促进彼此和谐共处、相容相生的积极意义,权利的和谐能使人与人、人与社会、人与国家、人与自然的关系处于相互协调、互相促进,最终促进人的全面协调的发展关系中,从而将外在的和谐内化为人自身的和谐。和谐作为权利的可能性部分,通过对比和联系古今中外思想家对于和谐内涵的解读,笔者认为和谐是多样性的统一,是具有差异性的不同事物的之间互相对立与统一,是不同事物之间相互彼此照应,彼此协调又充满活力的一种共生共荣的一种发展方式和状态。古代社会所追求的和谐体现的是统治阶级的意志,是一种非民主、平等的秩序,到近现代,随着个性的解放、理性的崇尚、人权的保障、个人价值的重视、民主的追求,传统的和谐价值面临着不断的挑战,这促使其不断发生变化,权利的价值体系不断得到丰富和发展,和谐理念被纳入到权利价值体系中。 权利的和谐价值的包容性。它与权利的其他价值既相互区别,又相互联系,成为一个一体化的权利价值系统;权利的和谐价值的伦理性,伦理道德作为一种内在的力量促进和谐社会的构建,法伦理问题的实质却是权利的问题,其存在原由与根本目的都是对权利的主张、保护与权利主体间矛盾的协调;权利的和谐价值的引导性。以和谐的思维转变权利实现的方式权利和谐价值指引我们从社会经济发展的现实出发,选择合适的时机将其转化为现实,既不能落后于社会的发展,也不能超越现实生产力的发展要求。 权利和谐价值的实现首先要加强宪政建设,突显权利的首要地位。主要从权利与义务、权利与权力的关系来突出权利的优先地位。加强立法工作,完善权利对客观利益的表达。通过立法,以巩固和加强人民政权,并且有利于权力机关的民主潜力充分发挥,通过立法,提高人民群众的参政意识并且能够发展基层民主自治制度,从而促进国家各方面的民主化进程以防止立法或者执法过程中对人民权利的侵犯。坚持依法行政,强化政府为权利服务的功能。通过加强对政府工作人员的行政伦理教育、服务伦理教育,提升政府工作人员的思想觉悟,培养政府工作人员的自律能力、主动服务意识和公仆意识,从根本上实现由管理者向服务者角色意识转变。坚持司法公正,确保权利平等保护。 本文在写作过程中注意大量参阅国内外对于权利的价值研究的专题,充分利用文献资料并且运用了相关的社会热点问题,使得研究课题与现实紧密联系,使得传统的课题有深入的社会新意。
[Abstract]:Rights theory has always been a concern in Chinese and foreign jurisprudence. Right is a theme of constant change and development. In three hundred years, the scope of rights has been expanding. From children, women, blacks, disabled persons, to homosexuality, more and more people have been respected by others, from political and civil rights to economy and society. In this case, in this case, the thought of the harmonious value of rights helps to guide people to harmoniously configure and operate rights, thus ensuring the harmonious development of rights. This paper studies the harmonious value of rights, which is divided into three parts:
Harmony as the value of rights has its necessity and possibility. The necessity of harmony as a right value is mainly from the conditions of rights produced and in different historical periods, different cultural perspectives, and different cognitive levels of human interpretation of rights, and the meaning of rights. Right and harmonious value is the object of rights to human itself, human and human beings. The society, the individual and the state, the human and the nature can promote the harmonious coexistence and the positive meaning of each other, and the harmony of the rights can make the relationship between man and man, man and society, man and state, man and nature in coordination, mutual promotion, and finally promoting the all-round and coordinated development of human beings, so that external harmony is internalized into human self. Harmony, as part of the possibility of the right, by comparing and linking the ancient and modern thinkers to the interpretation of harmonious connotations, I think that harmony is the unity of diversity, the opposite and unity of different things, is a kind of mutual care, coordination and vitality of each other. The harmony of the ancient society is a way and state of development. The harmony of the ancient society embodies the will of the ruling class. It is a non democratic and equal order. In the near modern times, with the liberation of the personality, the advocacy of reason, the protection of human rights, the attention of the individual value, the pursuit of democracy, the traditional harmony value faces constant challenges, which is prompted by the constant challenge. It is constantly changing, and the value system of rights has been enriched and developed. The concept of harmony has been incorporated into the value system of rights.
It is inclusive of the harmonious value of rights. It is different from the other values of rights, and it is related to each other. It becomes an integrated value system of rights; the ethics of the harmonious value of the right, the ethical and moral as an inherent force to promote the construction of a harmonious society; the essence of the problem of the law is the problem of rights, and its existence is the original. Both from the fundamental purpose are the right, the coordination of the contradictions between the protection and the rights subject, the guiding of the harmonious value of the right. The harmonious value of the right to change the right by the harmonious thinking leads us to the reality of the social and economic development, and the choice of the right time machine to turn it into reality, neither can we lag behind the society. The development of the productive forces can not surpass the requirements of the actual productive forces.
The realization of the harmonious value of rights should first strengthen the construction of constitutional government and highlight the primary status of rights. It mainly emphasizes the priority status of rights from the relationship between rights and obligations, rights and power, strengthens the legislative work, improves the expression of the rights to the objective interests. Through legislation, it strengthens and strengthens the people's power, and is beneficial to the democracy of the power organs. Full play of the potential, through legislation, to improve the people's consciousness of participation in political participation and to develop grass-roots democratic autonomy system, so as to promote the process of democratization in all aspects of the state in order to prevent the infringement of the rights of the people in the process of legislation or law enforcement. The administrative ethics education of the personnel, the service ethics education, the promotion of the ideological consciousness of the government staff, the training of the self-discipline ability of the government staff, the consciousness of active service and the consciousness of public servants, fundamentally realize the change from the managers to the role consciousness of the service providers, and the judicial justice and the equal protection of the rights.
In the process of writing, we pay much attention to the study of the value of rights at home and abroad, make full use of the literature and use the related social hot issues, making the research subject closely related to the reality, making the traditional topic have a deep social new idea.
