西藏自治区经济自治权实施过程中存在的问题及对策研究

【摘要】：随着世界经济全球化趋势的发展,各地区各国家之间的联系越来越密切,法律的作用也日益突显出来。建立合理有序的法律秩序,是各国经济发展的需要,本文选取了西藏自治区“经济自治权”作为研究的视角,为了通过分析西藏自治区经济自治权实施过程中存在的问题,提出相关的解决这些问题的意见和建议,解决实务中“经济自治权”虚掷的情况和现象,为宪法和法律所赋予西藏自治区的经济权利的顺利实施提出一些自己的看法。本文,笔者通过对于经济自治权的基本问题界定后,结合西藏自治区的区情,进行一定的学理分析,探究出经济自治权在西藏自治区实施过程中的问题,从而提出完善经济自治权行使的对策。从而更好的完善民族区域自治制度,完善西藏自治区的法治建设,进而可以促进西藏自治区经济又好又快的发展,促进各民族地区共同繁荣。本文的研究方法是运用文献查阅法与实地考察法相结合的方式,对西藏自治区的“经济自治权”进行研究,通过查阅了大量的文献与资料,了解了该问题的相关法理知识和前人所进行的研究成果,理解了该问题的普遍问题的所在,前人对这个问题的看法,进一步启迪出自己的想法和看法。然后,又到西藏自治区的财政部门、人大等部门的网站,查阅了当前所公之于众的法律法规,进行整合和分析,整理出这些材料所反映的问题,进而在次基础上,提出建设性的意见。本文将会整理成一篇关于研究西藏自治区“经济自治权”实施过程中存在的问题及对策研究的硕士毕业论文,作为我的毕业论文。对于在这篇论文中,笔者新的看法主要在于研究视角的新颖。关于西藏自治区的“经济自治权”研究很少。研究内容的新颖之处主要体现在,完善西藏自治区经济自治权相关内容和行使程序规定,形成较为完备的关于“经济自治权”行使的法律体系。划分清楚西藏自治区各级行政机关部门的权限范围,改变权限模糊和责任不清楚的现状。完善西藏自治区经济自治权执行和监督的相关体制,只有监督到位,追求监督者不作为的责任,才能更好的保障经济自治权的实施。提高西藏自治区的国家干部对于经济自治权的理解和重视,起到道德先锋带头的模范作用等等。这些都是在内容方面笔者提出的新的看法和见解。
[Abstract]:With the development of the world economic globalization, the relationship between countries in different regions is getting closer and closer, and the role of law is becoming more and more prominent. The establishment of a reasonable and orderly legal order is the need of the economic development of various countries. This paper selects the "economic autonomy" of the Tibet Autonomous region as the perspective of research, in order to analyze the problems existing in the implementation of the economic autonomy of the Tibet Autonomous region. This paper puts forward some suggestions and suggestions on how to solve these problems, solves the situation and phenomenon of "economic autonomy" in practice, and puts forward some opinions for the smooth implementation of the economic rights granted by the Constitution and laws in Tibet Autonomous region. In this paper, after defining the basic issues of economic autonomy and combining the regional situation of the Tibet Autonomous region, the author makes a certain theoretical analysis to explore the problems in the implementation of economic autonomy in the Tibet Autonomous region. Thus, the author puts forward some countermeasures to improve the exercise of economic autonomy. In order to improve the system of regional ethnic autonomy, improve the rule of law in Tibet Autonomous region, and then promote the economic development of Tibet Autonomous region, promote the common prosperity of various ethnic regions. The research method of this paper is to study the "economic autonomy" of the Tibet Autonomous region by combining the method of literature review with the method of on-the-spot investigation, and by consulting a large number of documents and materials, This paper has understood the relevant legal knowledge of the problem and the research results carried out by the predecessors, and has understood the general problem of the problem, and the former people's views on the problem, and further enlighten their own ideas and opinions. Then, on the website of the finance department of the Tibet Autonomous region, the people's Congress and other departments, they consulted the laws and regulations currently published to the public, conducted integration and analysis, sorted out the problems reflected in these materials, and then on a sub-basis, Offer constructive advice. This paper will be organized into a master's thesis on the study of the problems and countermeasures in the implementation of "Economic Autonomy" in Tibet Autonomous region, which is my graduation thesis. In this paper, the author's new views mainly lie in the novelty of the research perspective. There is little research on the economic autonomy of the Tibet Autonomous region. The novelty of the research is mainly reflected in the perfection of the relevant contents and rules of the exercise procedure of the economic autonomy of the Tibet Autonomous region, and the formation of a relatively complete legal system for the exercise of the "economic autonomy". The scope of jurisdiction of administrative departments at all levels in the Tibet Autonomous region should be clearly defined, and the status quo of vague powers and unclear responsibilities should be changed. To perfect the relevant system of implementing and supervising the economic autonomy of Tibet Autonomous region, only when supervision is put in place and the responsibility of supervisors not to act is pursued, can the implementation of economic autonomy be better guaranteed. To improve the understanding and importance of economic autonomy among state cadres in Tibet Autonomous region, and to play a role of moral vanguard in taking the lead and so on. These are the content of the author put forward new views and opinions.
