公民受教育权的平等保护:从“齐玉苓案”谈起

【摘要】:2001年6月28日,最高人民法院公布并实行了《最高人民法院关于以侵犯姓名权的手段侵犯宪法保护的公民的受教育的基本权利是否承担民事责任的批复》。肯定了陈晓琪以侵犯姓名权的方式侵犯了齐玉受宪法保护的受教育权。然而,2008年12月18日,最高人民法院明确废止了前面的批复。“齐玉苓案”早已尘埃落定,各界的争论声仍小绝于耳。然而透过这么一个小案件所折射出的公民受教育权的保护问题,各界似乎少有提及。该案所引起的关于我国宪法司法化的思考固然发人深省,但一个普通的民事案件,最高人民法院特意为此作出司法解释,还得劳烦宪法的大驾,才能为齐玉苓讨回公道。由此不得不引起我们的思考:面对现实中种种公民受教育权遭到侵犯、公民受教育权得不到平等对待的现状.这个时候我们应该怎么办?公民的受教育权是宪法赋予的五一项基本社会文化权利,平等应该是其第一要义。齐玉苓案不仅仅应该引起我们关于宪法是不是应该司法化的思考,更为重要的,是要引起我们对我国公民受教育权现状及如何平等保护我国公民的受教育权的反思。本文借“齐玉等案”,探讨我国公民受教育权保护过程中所遇到的问题和原因。第一章陈述了“齐玉苓案”的案情,简要的介绍学界关于“齐玉苓案”的讨论情况,从而引出“齐玉苓案”带给我们的思考和启示。第二章阐述公民受教育权的基本含义并论证平等保护公民受教育权的重要意义。第三章简要的说明我国公民受教育权实现的现状。第四章是本文的重点部分,重在解构我国公民受教育权所面临的一些主要问题,包括立法上、司法上、行政上等。第五章是本文的最后一章,是基于前面四个部分的阐述、分析得出的一些结论,是本人对我国保护公民受教育权的途径所做的一些思考。
[Abstract]:On June 28, 2001, the Supreme people's Court promulgated and carried out the "Supreme people's Court's approval on whether the basic right to education of the citizens protected by the Constitution should be infringed by the means of infringing the right to name". Chen Xiaoqi infringed the right to education protected by the Constitution in the way of infringing her right to name. However, on December 18, 2008, the Supreme people's Court expressly annulled the previous approval. Qi Yuling case has long been settled, the controversy of all walks of life is still quiet in the ear. However, the protection of citizens' right to education reflected in such a small case seems to be rarely mentioned. The thinking about the judicature of our constitution caused by this case is certainly thought-provoking, but in an ordinary civil case, the Supreme people's Court has made a special judicial interpretation for this, and has to bother the Constitution to obtain justice for Qi Yuling. Therefore, we have to think about the fact that the right of citizens to receive education is infringed and the right to education is not treated equally in reality. What should we do at this time? The citizen's right to education is a basic social and cultural right given by the Constitution, and equality should be its first meaning. Qi Yuling's case should not only cause us to think about whether the constitution should be judicialized, but also, more importantly, cause us to reflect on the present situation of our citizens' right to education and how to protect our citizens' right to education equally. This paper discusses the problems and reasons in the process of protecting the right to education of Chinese citizens by the case of Qi Yu. The first chapter states the case of Qi Yuling and briefly introduces the discussion of Qi Yuling case in academic circles, which leads to the thinking and inspiration brought by Qi Yuling case. The second chapter expounds the basic meaning of citizen's right to education and demonstrates the significance of equal protection of citizen's right to education. The third chapter briefly describes the status quo of the realization of the right to education of Chinese citizens. The fourth chapter is the focus of this paper, focusing on the deconstruction of the right to education of Chinese citizens facing some major problems, including legislation, judicial, administrative, and so on. The fifth chapter is the last chapter of this paper, which is based on the previous four parts of the elaboration, the analysis of some conclusions, the author of our country to protect the right to education of citizens to do some thinking.
