转型社会中农民政治诉愿的天然与法定——农民政治诉愿权困境与对策分析

【摘要】：从传统乡土社会走向现代民主社会,是中国法治型道路的必然选择。在社会转型中,必然带来不同主体间的利益博弈。作为中国最大弱势群体的中国农民如何在利益博弈中主张并实现自己的利益,已经成为当前社会不可回避的紧迫问题。中国农民的政治诉愿权本应是一种自然的政治权利,但却在社会现实中未能得到法律上有效认可和社会制度有效保障。权利的生命在于运行。中国农民在过去、现在乃至未来都是中国社会前进的主要推动者。正处于社会转型的中国必须充分认识、尊重并有效保障中国农民的政治诉愿权。
[Abstract]:Moving from traditional local society to modern democratic society is the inevitable choice of the road of rule of law in China. In the social transformation, it will inevitably bring about the benefit game between different subjects. As the most vulnerable group in China, how Chinese farmers advocate and realize their own interests in the interest game has become an unavoidable and urgent problem in the current society. The political appeal right of Chinese peasants is supposed to be a kind of natural political rights, but it has not been effectively recognized by law and protected by social system in social reality. The life of right lies in operation. Chinese farmers in the past, present and even future are the main propellants of Chinese society. In the process of social transformation, China must fully recognize, respect and effectively protect the political appeal rights of Chinese farmers.
