防控犯罪视域下的工程建设监管机制研究

【摘要】：在工程建设领域,招投标环节、工程设计部门、建设施工部门、中介部门等与此相关的各个部门的管理人员,只要利用手中的职权谋取私利都可以归结于职务犯罪,这些犯罪行为既破坏了社会的正常秩序,还对国家和社会公众造成了极大的经济损失,因此,必须加强犯罪防控,超出了防控犯罪领域的行为都应该受到刑事处罚。首先笔者对国内外工程建设监管机制的现状进行描述,介绍工程建设各环节的相关概念及犯罪行为,然后根据工程建设领域的特点,分析工程建设领域存在的巨大的利润空间、领导人员的法制观念淡薄、克己奉公能力差,工程建筑领域存在的各类不正当的竞争行为等,相关监管部门的监管手段不合理,对已经发生的犯罪现象打击力度不够等这些方面入手,在当前防控犯罪工作日益深入的背景下,进一步分析了建筑领域犯罪产生的原因。然后提出了对工程建设监管机制的建议,讨论了相应的改革模式。提出可以从法律和制度两个角度入手,严格规范工程审批,对于发包方、承包方、中介方以及施工方的责任要落实到位。各个环节紧密相连,前后相互制约,防止任何一个环节出现贪腐问题。从工程的整个角度出发,在工程前期施工阶段就要建立以教育为核心的防控机制以及市场准入和推出机制,形成科学合理的规划施工方案；在工程中期的建设环节中,要采用国际工程监理“2R制度”,在保证工程质量的同时,还要严把款项拨付关；在工程末期的竣工验收环节,规范程序性和技术性验收,广泛推行法律责任问责制。让整个工程建设各个环节都受到相应的监管,杜绝腐败现象的发生所以,笔者认为,建筑领域的各个生产过程都可以根据不同的特点划分成若干部分,有针对性的进行分析和研究,并找出相应的解决对策,进一步完善建筑领域犯罪防控机制。
[Abstract]:In the field of engineering construction, project bidding links, design department, construction department, intermediary Department and other departments and the relevant management personnel, as long as the use of their powers for personal gain can be attributed to the crime, the crime not only destroys the normal social order, but also to the state and society caused great public the economic loss, therefore, must strengthen the prevention and control of crime, beyond the field of crime prevention and control action should be subject to criminal penalties. The author works on the status of supervision mechanism construction at home and abroad are described, and introduces related concepts of each part of the project construction and crime, and then according to the characteristics of the engineering construction field, analysis of huge profits, in the field of construction of the executives of the weak notion of the legal system, there are all kinds of wholehearted devotion to public duty ability, the engineering construction field unfair competitive behavior, the relevant regulatory authorities supervision means the unreasonable phenomenon of crime has occurred, the crackdown is not enough etc. these aspects, in the background of the crime prevention and control work is increasingly deepening, further analyzes the causes of crimes in the field of the building. Then it puts forward some suggestions on the supervision mechanism of engineering construction, and discusses the corresponding reform mode. From two angles of law and system, we must strictly standardize the engineering examination and approval, and implement the responsibility for the contractor, the contractor, the intermediary and the constructor. Each link is closely connected and restricts each other to prevent corruption in any part of the link. Starting from the project of the whole point of view, it is necessary to establish prevention mechanism to education as the core, market access and exit mechanism in the early stage of engineering construction, the formation of scientific and rational planning of construction scheme; construction engineering links in the medium-term, to adopt the international engineering supervision "2R system", to ensure the quality of the project, but also strict payment; in the end of the project completion and acceptance process, standardized procedures and technology acceptance, the widespread implementation of legal responsibility accountability system. Let the whole construction links are subject to appropriate supervision, prevent the occurrence of corruption so that the author believes that the building area of each production process can be divided into several parts according to the different features of the analysis and research, and find out the corresponding countermeasures, to further improve the construction field of crime prevention and control mechanism.
