【摘要】：在科技日益进步的今天,许多新兴事物应运而生,其中就包括了很多新型化的犯罪手段。这些新出现的犯罪手段因为自身的新奇和稀少,让人们虽然比较容易辨识其犯罪的本质,却很难界定其所犯究竟何罪,这也会给司法机关造成不小的压力,使法官在定罪与量刑上犹豫不决。结合盗窃罪与诈骗罪的关系对近日微信朋友圈中所盛传的、被法律人争论不休的一条案例进行简要的剖析。
[Abstract]:Progress in science and technology today, many new things have emerged, including many new types of crime means. These new crime means because of its novelty and scarce, let people is easy to identify the essence of the crime, but it is difficult to define what they commit crime, it will cause no small the pressure to the judicial organs, the judge shilly-shally in conviction and sentencing. Combined with the relationship between the crime of theft and fraud on WeChat recently in the circle of friends that, by a case of legal person debate are briefly analyzed.
