【摘要】：正导语:近年来,危害生产安全刑事案件频发,持续引发社会关注。对于这些犯罪,该如何定罪量刑?对于身居幕后的"隐名持股人",该如何追责?对于事故背后的贪污贿赂和渎职犯罪,该如何处理?哪些情节会从重处罚?对于危害生产安全的犯罪又该如何预防?针对上述备受关注的问题,最高人民法院、最高人民检察院联合发布了《关于办理危害生产安全刑事案件适用法律若干问题的解释》(以下简称《解释》),并于2015年12月16日起实施。
[Abstract]:Positive words: in recent years, frequent criminal cases endangering production safety, continue to arouse social concern. For these crimes, how to be convicted and sentenced? For the "hidden shareholders" behind the scenes, how to pursue responsibility? How to deal with corruption, bribery and malfeasance behind the accident? Which circumstances will be severely punished? How to prevent the crime of endangering production safety? In view of the above issues of great concern, the Supreme people's Court and the Supreme people's Procuratorate jointly issued the interpretation of certain issues applicable to the Law applicable to handling Criminal cases against production Safety (hereinafter referred to as "interpretation"). It will be implemented on December 16th 2015.
