拒不支付劳动报酬罪的司法认定与处罚问题研究

【摘要】:拒不支付劳动报酬罪侵害的法益是劳动者所应获得劳动报酬的所有权。相应的该罪的行为对象就是劳动者的劳动报酬。在“劳动报酬”上,存在着一定的争议。争议的角度在于社会保险、住房公积金和经济补偿金是否属于其范畴。笔者认为,扩张说有一定的合理性,但是又不完全拘泥于该学说,即住房公积金和经济补偿金应属于“劳动报酬”的范围,而社会保险则应排除在外。 在拒不支付劳动报酬的行为方式上,存在着积极不作为和消极不作为的两种形式。积极不作为方式包括:隐匿、转移财产,恶意清偿,虚构债务,虚假破产,虚假倒闭;逃跑、藏匿;隐匿、销毁、篡改材料。消极不作为指有能力支付拒不支付,此处的“能力”应该既包括完全支付能力,同时也包括部分支付能力;支付的时间则应该限定在用工单位承担支付义务起,到有关政府部门责令限期改正的届满之日;在有能力支付而不支付的证明上,应当实行举证责任倒置。对于特殊情形下的拒不支付行为应该具体问题具体分析。拒不支付劳动报酬的“严重后果”包括严重影响劳动者及其亲属正常生产和生活、对劳动者使用暴力或进行暴力威胁以及其他严重后果。其中,暴力和威胁的对象是指劳动者本人及其亲属,暴力应当达到造成劳动者及其亲属伤亡的程度,而威胁应该达到足以使劳动者自动放弃讨薪行为。拒不支付劳动报酬罪的行为主体包括自然人主体和单位主体。对于像建筑关系、实习关系、劳务派遣、劳务关系等复杂关系的犯罪主体的确定,则要结合因果关系理论进行分析。 拒不支付劳动报酬罪的处罚具有行政附属性,,即“经政府有关部门责令支付仍不支付”是成立拒不支付劳动报酬罪的前置性条件。其中,“政府有关部门”,是指人民政府、劳动监察保障部门,不应该包括法院、劳动争议仲裁委;责令支付最好应限制在10至30天为宜。在拒不支付劳动报酬罪的处罚上,刑法规定对有履行相关义务者应从宽处罚,适用法定从宽情节的基本条件是尚未造成严重后果和行为人必须依法履行支付义务和承担赔偿责任。
