“受虐妇女综合症”作为法定量刑情节的可行性研究

【摘要】：“受虐妇女综合症”是指长期受丈夫或男友暴力虐待的妇女表现出的一种特殊的行为模式。这类妇女由于难以在配偶的暴力中找到出路，逐渐在心中形成了一种心理上的疾病，这种疾病被归结为一种模式。借助这种模式，我们可以解释长期受到家庭暴力虐待的一贯表现良好的妇女为何会在忍无可忍之后选择了杀夫的道路。 “受虐妇女综合症”已经在西方一些国家作为可采证据被广泛适用，这不仅维护了法律的权威和尊严，还在很大程度上以最后一道防线的方式保护了受虐妇女的生存的权益。我国近年来家庭暴力案件数量有上升趋势，受虐妇女杀夫的案件也时有发生。本文从“受虐妇女综合症”的概念和特征入手，在分析了量刑情节的考量因素的基础上，综合我国司法实践经验和我国国情，探讨了“受虐妇女综合症”在我国成为法定量刑情节的可能性，并提出倡议，希望“受虐妇女综合症”能够给予受虐妇女一次重生的机会。

Battered women's syndrome has been widely applied in western countries as evidable evidence, which not only safeguards the authority and dignity of the law, but also largely protects the abused women's rights and interests in the last line of defense.
Our country in recent years the number of cases of domestic violence is on the rise, the battered woman killed her husband's cases have also occurred. This article from the concept and characteristics of "battered woman syndrome" to start, based on the analysis of the factors of sentencing on Comprehensive Chinese judicial practice experience and the situation of our country, discusses the "battered women's syndrome" the possibility of a statutory sentencing in our country, and puts forward some suggestions, hoping to "battered woman syndrome" can give battered women a rebirth.
