多维视角下的非法占有目的解读

【摘要】：非法占有目的，既是一个新问题也是一个老问题，既是一个小问题也是一个大问题。随着社会经济的发展、经济活动内容的复杂，非法占有目的的表现形式、涉及的具体问题也呈多样化形态，那么，如何认定犯罪嫌疑人具有非法占有目的就成为了困扰司法的实践性问题。对于其中的各种具体问题，不同学者往往直接针对非法占有目的具体问题本身直接展开探讨、研究，进而形成各种观点、理论的纷争。但是，这些争论的背后往往忽视了一个重要的前提性问题，那就是这些探讨并未对于这一问题归属何种层面，这一问题中同一概念的内涵、外延，不同概念之间的区别与联系等基础性问题做出澄清与界定，那么，这种未纯化语义、未纯化语境的争论更多情况下往往是各学者相互之间语义传递中的损耗而非思想上的真正交锋。非法占有目的及其中具体问题的解读并非孤立存在的，也非静止的，而是一个动态的过程，而这个过程就是事实与规范之间，规范与价值之间逐步实现的逻辑路径。本文从概念、体系、事实和价值四个层面对非法占有目的当中具有典型代表性的部分具体问题展开探讨。概念层面，主要针对非法占有目的概念指称对象的厘清展开，并以概念的语义为基础反向划定非法占有目的的边界，将其与其他近似概念相区分。体系层面，主要从犯罪构成理论体系与刑法分则体系两个角度展开。事实层面，，侧重探讨特殊事实的认定及非法占有目的认定困难场合的刑事推定问题。价值层面，主要探讨非法占有目的的制度性价值及其实现问题。在规范、事实与价值之间，笔者拟从不同层面尝试勾勒出非法占有目的整体解读的框架与路径，以期为不同视域下的非法占有目的的理论融合提供有益尝试。解读的方法和框架可能比我们从非法占有目的具体问题中解读出的结论更具有普遍意义。
[Abstract]:The purpose of illegal possession is not only a new problem but also an old one, a small problem as well as a big one. With the development of social economy, the complexity of economic activities, the manifestation of illegal possession purpose, The specific problems involved are also diversified, so how to identify the criminal suspect with the purpose of illegal possession has become a practical problem puzzling the judiciary. For each of these specific problems, different scholars often directly discuss and study the specific problem of the purpose of illegal possession, and then form disputes of various viewpoints and theories. However, Behind these debates, an important prelude problem is often overlooked, that is, the discussion does not belong to the problem at what level, the meaning of the same concept in this problem, extension, The differences and connections between different concepts are clarified and defined, so this kind of unpurified semantics, The argument of unpurified context is more often the loss of semantic transmission between scholars than the real confrontation of ideas. The interpretation of the purpose of illegal possession and its specific problems is not isolated, nor static, but rather a dynamic process, which is between fact and norm, The logical path between norm and value. This paper discusses some typical specific problems in the purpose of illegal possession from four aspects: concept, system, fact and value. Mainly aiming at the clarification and development of the object of reference of the concept of illegal possession, and delineating the boundary of the purpose of illegal possession on the basis of the semantics of the concept, differentiating it from other approximate concepts. Mainly from the two angles of criminal constitution theory system and criminal law sub-rule system. In fact level, it focuses on the problem of criminal presumption in the difficult situation of the identification of special facts and the purpose of illegal possession. This paper mainly discusses the institutional value of the purpose of illegal possession and its realization. Between norms, facts and values, the author attempts to outline the framework and path of the overall interpretation of the purpose of illegal possession from different levels. In order to provide a useful attempt for the theoretical fusion of the purpose of illegal possession in different horizons, the method and framework of interpretation may be more universal than the conclusion we have drawn from the concrete problem of the purpose of illegal possession.
