医疗行业商业贿赂犯罪的防治体系研究

【摘要】：反商业贿赂是推进国民经济健康发展的重要环节,能否有效控制商业贿赂的案发率,从而构建健康和谐稳定的社会氛围是格外重要的。笔者选择医疗行业这一商业贿赂的高发领域作为本文的切入点,结合当前互联网大数据的背景,对于医疗行业内的商业贿赂犯罪案例进行数据上的分析,就目前可以检索到的全部案例进行归类总结,以犯罪学的研究视角,剖析医疗行业内的商业贿赂行为。首先,在整个文章的导论部分着重提出问题并将这一提出的问题贯穿全文。针对目前商业贿赂行为的横行肆虐,相反的群众对其存在竟然逐渐麻木放纵,这一现状应当足以引起社会的警惕,许多商业贿赂行为在日常生活中逐渐演变成了一类“潜规则”,得到社会无奈的接纳甚至认可,这无疑是非常危险的境地,对行为人本身容易导致其逐渐走上犯罪的道路,对于整个社会也是不良风气的扩散,因此关注商业贿赂的防治无疑是迫在眉睫的。笔者在收集案件数据的过程中,发现案发医疗行业的案件数目足足占到全部案件的半数,因此医疗行业的商业贿赂行为防治工作应当作为重中之重。目前在学术界对于医疗行业内商业贿赂犯罪的研究并未占据主流,有部分学者提出了自己的防治观点,与此同时国际上也有部分反商业贿赂的先进经验值得我国学习。本文的研究思路主要是借助当前大数据的背景,收集、整理案例中的信息,并根据信息得出相关犯罪的特征框架,并根据现有的信息归纳总结出商业贿赂行为的防治体系,文章遵循提出问题——分析问题——解决问题的思路,采用犯罪学最基础的研究体系,每个部分都给予一定笔墨充分论述,最终得出饱满的结论。接下来,在商业贿赂犯罪的现象论部分集中列举收集到的数据,以图表的形式清晰的呈现各个特征,其中着重强调医疗行业商业贿赂犯罪的高发性,并关注定罪、量刑两部分应当关注的问题,商业贿赂现在并没有作为单独的罪名出现在我国的刑法典中,因此应当关注每类行为的入罪方式,并关注何种因素会影响入罪,是否存在争议等问题,在量刑部分重点关注影响量刑的情节是否广泛存在,整体的处罚倾向如何等问题。对数据归纳结束后,现象论中还包括论述目前医疗行业中商业贿赂的存在形式与商业贿赂的危害性。在这一部分着重呈现商业贿赂的多样性、隐蔽性以及对于整个社会以及每一位社会成员都具有极其恶劣的影响。医疗行业商业贿赂犯罪的原因论作为本文的重点章节之一,从犯罪原因的概述、社会原因、文化原因、心理原因等四个方面出发,全面的论述了该类行为发生的原因,其中社会原因中囊括了政府投入不足等政治性原因,同时医疗行业基于特殊的历史背景形成了“以医养药”的行业模式,医疗机构内部也存在类似的诞生于特定历史时期的体制性因素,都造成了商业贿赂多发的现状,中国也自古以来就是人情社会,商业贿赂逐渐作为社会中暗藏的潜规则而存在。医生群体作为投入大、收入少的低性价比行业,心理上难免失衡。在多种因素的共同作用下,自然形成当前局面。最后一部分是医疗行业商业贿赂犯罪的防治论,这一部分同样是本文的重点章节。该部分针对商业贿赂高发的原因,因地制宜的提出了一系列防治措施,其中包括制度性预防、社会预防、体制性预防、心理预防等方面。从不同的角度出发阐述相应的预防方法,从而达到犯罪预防的目的。
