“酒后代驾”民事责任探析

【摘要】：酒后代驾作为一种新型行业,一直以来在我国零零点点的分布,没有统一的行业标准,更没有完善的法律机制予以规范。2011年5月1日实施的我国《刑法修正案(八)》把酒驾归入了犯罪的范畴,同时新修正的《道路交通安全法》也加大了对酒后驾驶的惩罚力度。在这样的社会背景下,酒后代驾突破了以前的狭小空间,迅速在全国各地蔓延开来。然而,对于大众群体而言,酒后代驾还很陌生,加之行业存在的法律问题严重,更使得酒后代驾扑朔迷离。因此,本文一共分为四章,从四个方面全面分析酒后代驾中存在的法律问题。第一章介绍了酒后代驾的相关基本概念,从概念到形成原因,再到分类,系统的介绍了酒后代驾的基本概况。第二章则重点分析酒后代驾主体的资格,分别探讨了代驾人与车主的民事主体资格,以便为后面论述提供铺垫。第三章在第二章的基础上分析了酒后代驾合同的效力和性质,明确了在不同情况下签订合同的效力。最后一章重点分析了酒后代驾中的民事责任承担问题,对不同的酒后代驾服务中的民事责任进行了分类探讨。希望通过以上四章的分析,能够明确酒后代驾中的相关法律问题之所在,然后提出自己的见解,以期我国酒后代驾能够合法健康地发展。
[Abstract]:As a new type of industry, alcoholic drink driving has always been scattered in China, and there is no uniform industry standard. In May 1st 2011, our country's Criminal Law Amendment (8) classified drunk driving as a crime. At the same time, the newly amended Road Traffic Safety Law has also increased the punishment for drunk driving. In such a social background, the alcoholic descendants' driving has broken through the previous narrow space and spread rapidly throughout the country. For the mass group, the future generations of wine driving is still very strange, coupled with the serious legal problems in the industry, which makes the future generations of wine driving confusing. Therefore, this paper is divided into four chapters. The first chapter introduces the related basic concepts, from the concept to the formation of the reasons, and then to the classification. Chapter two focuses on the analysis of the qualification of the driving subject of the descendant, and discusses the civil subject qualification of the substitute driver and the owner, respectively. In order to provide a cushion for the following discussion. Chapter three analyzes the effectiveness and nature of the driving contract for future generations on the basis of chapter two. The last chapter focuses on the analysis of the civil liability of the future generation driving, and discusses the classification of the civil liability in the service of the different descendant driving. I hope that through the above four chapters of the analysis, To clarify the relevant legal problems in the driving of future generations, and then put forward their own views, in the hope that the future generations of our country can legally and healthily develop.
