非法堕胎行为的刑法规制

【摘要】：计划生育是我国的基本国策，，国家对堕胎的态度一直是放任的，因此在我国大陆地区堕胎是合法的，人们对我国的堕胎问题一直以来关注较少。但并不意味着我国所有的堕胎行为都是合法的，我国也存在非法堕胎的行为。直到近几年由于选择性别堕胎而引起男女性别比例失衡问题突出，人们才开始关注非医学需要的选择性别堕胎问题，国家和各级地方政府制定了相应的法律法规。结合我国的国情以及借鉴国外的堕胎犯罪，中国的非法堕胎行为除了选择性别堕胎外，由于堕胎手段、主体或者时间等非法的原因，还存在其他形式的非法堕胎行为。通过考察目前的刑法规范发现并不能完全规范现有的非法堕胎行为，导致犯罪行为人因法律的纰漏而逃脱法律的惩罚。同时刑法理论界对非法堕胎行为的研究也相对欠缺。通过考量现有立法的不足，结合借鉴国外关于堕胎犯罪的立法经验，因此认为有必要通过增设非法堕胎罪来规制我国的非法堕胎行为。这样不仅能打击非法堕胎犯罪，维护我国的社会秩序，而且能保障孕妇的身体健康和生命安全。也能减少计划生育工作人员乱来的行为，同时更好地实施计划生育的基本国策。
[Abstract]:Family planning is the basic national policy of our country, and the state's attitude towards abortion has always been laissez-faire, so abortion is legal in mainland China. People have always paid less attention to abortion in our country. But it does not mean that all abortions in our country are legal. There is also illegal abortion in our country. Only in recent years did people begin to pay attention to the problem of sex-selective abortion, which has caused the imbalance between men and women due to sex-selective abortion. The state and local governments at all levels have formulated corresponding laws and regulations. In the light of China's national conditions and drawing lessons from foreign abortion crimes, China's illegal abortion behavior, in addition to the choice of sex abortion, is due to abortion methods. There are also other forms of illegal abortion due to illegal reasons such as subject or time. Through an examination of the current criminal law norms, it is found that the existing illegal abortion behavior cannot be completely regulated. At the same time, the research on illegal abortion in the criminal law theorists is also relatively lacking. By considering the shortcomings of the existing legislation, we can learn from the experience of foreign countries on abortion crime legislation. Therefore, it is necessary to regulate illegal abortion in our country by establishing the crime of illegal abortion. In this way, we can not only crack down on the crime of illegal abortion, but also maintain the social order in our country. Moreover, it can ensure the health and safety of pregnant women. It can also reduce the behavior of family planning workers, and at the same time, better implement the basic state policy of family planning.
