【摘要】：食品是人类生存不可或缺的物质，人类缺了食品就如同人类缺了氧气，食品影响社会上每个体的生存，影响的不仅仅是社会上经济物质，更是社会广大人们群众的人身健康和生命安全，众所周知，人类的食品安全与人类的生存息息相关。可是，从近几年的食品安全情况来看，生存、销售有毒、有害食品犯罪行为的增长趋势有升无减。一方面，本罪是涉及面广泛的经济犯罪，本罪具有长期性、隐蔽性、潜在危害性的显著特征，涉及手段、犯罪行为人、犯罪对象面广，一旦发生食品安全危害事件，牵连的是一系列的问题。另一方面，市场本身具有自发性，食品生产者、销售者为了追求自身的利益、为了追求最低成本、最高利润而将广大人们群众的生命健康置之度外。如近年来发生的地沟油事件就充分体现出了经济市场食品生产者、销售存在着认识客观世界的局限性。所以，当经济市场无法自律时，这就需要法律发挥其作用规范违法犯罪行为。我国现行刑法144条规定生产、销售有毒、有害食品罪，，刑法界对本罪也有越来越深入研究，笔者认为本罪依然存在不完善的地方，本文通过从三大方面研究探本罪，第一部分分析生产、销售有毒、有害食品罪的主要构成特征，第二部分分析本罪的共犯形态，从分析中发现问题，立足于我国的实际情况，从实际出发思考食品犯罪存在的问题。同时借鉴他国的立法理论和经验，希望它山之石可以攻玉。最后提出相关的对策和具体的建议，以便更好地符合社会实践的要求，更好地与刑法体系相协调共同规范食品犯罪行为，更好地促进社会主义和谐，实现伟大的中国梦。
[Abstract]:Food is an indispensable material for human survival. The lack of food is like the lack of oxygen. Food affects the survival of every body in society, not just social economic material.As we all know, human food safety is closely related to human survival.However, from the food safety situation in recent years, the growth trend of the criminal behavior of survival, sale of poisonous and harmful food has been increasing unabated.On the one hand, this crime is an economic crime involving a wide range of aspects. It is characterized by its long-term nature, concealment and potential harmfulness, involving means, perpetrators, and a wide range of targets. Once a food safety hazard event occurs,A series of questions are involved.On the other hand, the market itself has spontaneity, food producers, sellers in order to pursue their own interests, in order to pursue the lowest cost, the highest profit and the lives and health of the broad masses of people.For example, in recent years, the events of gutter oil have fully reflected the food producers in the economic market, and the sales have the limitation of understanding the objective world.Therefore, when the economic market can not self-discipline, this requires the law to play its role in regulating criminal activities.Article 144 of our country's current criminal law stipulates that the crime of producing, selling poisonous and harmful food, the criminal law circle also has more and more in-depth research on this crime, the author thinks that this crime still exists imperfect place, this article through the research from three major aspects to explore this crime,The first part analyzes the main constituent characteristics of the crime of producing, selling poisonous and harmful food, the second part analyzes the form of accomplice of the crime, finds problems from the analysis, and bases itself on the actual situation of our country.Thinking about the problems existing in food crime from the point of view of reality.At the same time, learn from the legislative theory and experience of other countries, hope its stone can attack jade.Finally, the author puts forward relevant countermeasures and concrete suggestions in order to better meet the requirements of social practice, better coordinate with the criminal law system to regulate food crime, promote socialist harmony, and realize the great Chinese Dream.
