集群犯罪形成机制与预防研究

【摘要】：集群犯罪是指参与人数众多、违反社会规范、由众多人的狂热行为而导致的具有一定社会危害性的行为。近年来，我国经济快速发展，各类社会矛盾日益凸显，，因政府与百姓之间的利益纠纷而上升为集群犯罪的案例有增无减，因而有必要展开针对集群犯罪的专项理论研究，为实践提供理论支撑。鉴于我国犯罪学的研究思路是“确定研究对象→解释犯罪规律→探寻犯罪成因→指出预防方法”，本文的写作路径亦遵照该犯罪研究模式。首先，指明本文的研究对象是集群犯罪，而非一般意义上的群体性事件。集群犯罪是一类具有社会危害性的群体性暴动行为，是犯罪学领域的研究课题。同时，集群犯罪具有突发性、情绪性、残忍性等心理特征与严重的社会破坏性、无组织性等行为特征。因此，集群犯罪并不等同于尚未经过法律否定性评价的群体性事件，或者说群体性事件是集群犯罪的上位概念。其次，为挖掘集群犯罪的形成规律，本文从集群效能入手逐步展开论述，即依照“集群效能→集群行为→集群犯罪”的逻辑，指出集群犯罪的形成是通过集群效能的不断积聚累积集群行为的心理动机，最终在突发因素的影响下病变为集群犯罪。因此，集群犯罪的爆发并非一蹴而就，而是在各种前因变量的综合作用下发展而来。再次，从集群犯罪的演进规律中构建集群犯罪形成机制——集群犯罪化学反应方程式。借助化学反应方程式的原理将集群犯罪成因划分为带菌集群、致罪因素与突发因素。带菌集群与致罪因素可视为集群犯罪爆发的内外因，在其动态相互作用过程中，借助突发因素的出现，将潜藏在群体内部的反社会性暗示外化为具体的犯罪行为。最后，以破坏集群犯罪化学反映方程式等式结构为切入点，拔除带菌集群、致罪因素与突发因素的形成源头，从宏观、微观两个层面提出针对集群犯罪的长效和应急预防策略，即割裂集群犯罪形成的内外因并遏制突发因素。
[Abstract]:Cluster crime refers to the social harmfulness behavior caused by the fanatical behavior of many people, which involves a large number of participants, violates the social norms and is caused by the fanatical behavior of many people.In recent years, with the rapid economic development of our country, all kinds of social contradictions have become increasingly prominent, and the cases of rising to cluster crime due to the interests dispute between the government and the common people are increasing, so it is necessary to launch a special theoretical research on cluster crime.To provide theoretical support for practice.In view of the fact that the train of thought of criminology in our country is "to determine the object of study and explain the law of crime and to find out the cause of crime and point out the prevention method", the writing path of this paper also follows the research mode of crime.Firstly, it points out that the research object of this paper is cluster crime, rather than group events in general sense.Cluster crime is a kind of mass insurrection with social harmfulness, which is a research subject in criminology field.At the same time, cluster crime has the psychological characteristics of sudden, emotional, cruel and serious social destructive, unorganized and other behavioral characteristics.Therefore, the cluster crime is not equal to the group event which has not been evaluated by law, or group event is the superior concept of the cluster crime.Secondly, in order to excavate the formation law of cluster crime, this paper starts with cluster efficiency and discusses it step by step, that is, according to the logic of "cluster efficiency and cluster crime",It is pointed out that the formation of cluster crime is the psychological motive of accumulating cluster behavior through the accumulation of cluster efficiency, and finally changes into cluster crime under the influence of sudden factors.Therefore, the outbreak of cluster crime is not accomplished overnight, but developed under the comprehensive action of various pre-dependent variables.Thirdly, the formation mechanism of cluster crime, the chemical reaction equation of cluster crime, is constructed from the evolution law of cluster crime.According to the principle of chemical reaction equation, the causes of cluster crime are divided into colony with bacteria, crime factors and sudden factors.In the process of its dynamic interaction with the emergence of sudden factors, the anti-social implication hidden in the group can be externalized as a specific criminal act.Finally, taking destroying the equation structure of the chemical reaction equation of crime cluster as the breakthrough point, removing the colony with bacteria, the formation source of the crime causing factor and the sudden factor, putting forward the long-term effect and emergency prevention strategy for the cluster crime from the macro and micro levels.That is to split the formation of cluster crime internal and external causes and contain sudden factors.
