虚假诉讼罪制度研究

【摘要】：近年来,虚假诉讼案件在我国很多地区大量出现,不但严重侵犯了他人的合法权益,而且对司法秩序的正常有序运转也带来极大危害。但针对这一行为,在《刑法修正案(九)》颁布之前,并无一个明确的规定予以规范,多以民事处罚为主,各地司法实践做法也不尽相同。近几年,虽然也有对虚假诉讼的刑事判例出现,但防范和打击效果并不明显。为适应时代发展和司法实践需要,2015年8月29日通过的《刑法修正案(九)》在条文中明确增设了虚假诉讼罪,这必将对遏制虚假诉讼行为的日益泛滥起到巨大的促进作用。由于该罪名新立,学界理论分析尚不透彻,司法实践中新问题、新情况层出不穷,实践经验仍然缺乏。为增加对新罪名的理解和把握,笔者将从对虚假诉讼行为的界定入手,来探讨虚假诉讼罪在司法适用中存在的问.题,并提出一些自己的完善建议。文章将从以下四个部分对虚假诉讼罪进行全面探讨:在对虚假诉讼的含义及与相关联概念进行比较的基础上,对虚假诉讼行为作一明确界定;然后重点对我国有关虚假诉讼立法现状及法律适用问题进行分析,指出虚假诉讼罪立法上存在的不足,并对该条文在司法实践的使用进行探讨与思考,进一步增加对该行为的认识和了解;第三、四部分则是通过介绍国外相关规定,对我国虚假诉讼行为的防范从立法完善及其他司法机制上给予笔者自己的思考和建议。希望通过本文的写作,归纳总结现有的研究成果,提出在实际工作中对虚假诉讼罪适用时存在的困惑和思考,从理论上厘清该罪名的适用范围、适用对象,同时为完善其相关规定提供一些可行性的建议,以期能更好的服务司法,打击犯罪。
[Abstract]:In recent years, a large number of false litigation cases appear in many areas of our country, which not only seriously infringes on the legitimate rights and interests of others, but also brings great harm to the normal and orderly operation of judicial order.However, before the promulgation of the Criminal Law Amendment (9), there is not a clear stipulation to regulate this behavior, most of which are mainly civil punishment, and the judicial practice is different from each other.In recent years, although there are criminal precedents on false litigation, the effect of prevention and strike is not obvious.In order to adapt to the development of the times and the needs of judicial practice, the Criminal Law Amendment (9), adopted on August 29, 2015, explicitly added the crime of false litigation, which will certainly play a great role in curbing the proliferation of false litigation.Due to the new charge, the theoretical analysis of academic circles is not thorough, new problems and new situations emerge in judicial practice, and practical experience is still lacking.In order to increase the understanding and grasp of the new charges, the author will start with the definition of false litigation behavior, to explore the existence of false litigation in the judicial application.Question, and put forward some of their own suggestions for improvement.The article will discuss the crime of false litigation from the following four parts: on the basis of the comparison of the meaning of false litigation and related concepts, the author makes a clear definition of false litigation;Then it analyzes the current situation of the legislation and the application of the law, points out the shortcomings in the legislation of the crime of false litigation, and probes into and ponders over the use of this provision in the judicial practice.Further increase the understanding and understanding of this act; third, the fourth part is through the introduction of foreign relevant provisions, the prevention of false litigation acts in China from the legislative improvement and other judicial mechanisms to give my own thoughts and suggestions.Through the writing of this article, I hope to sum up the existing research results, put forward the confusion and thinking when the crime of false litigation is applicable in the actual work, and clarify the scope of application and the applicable object of the crime in theory.At the same time, it provides some feasible suggestions for improving its relevant regulations, in order to better serve the judiciary and combat crime.
