破坏生产经营罪司法适用研究

【摘要】：破坏生产经营罪的法益既不是财产所有权,也不是生产经营秩序,而是生产经营的经济利益。本罪行为对象是生产经营,生产经营不要求以营利为目的,非法的生产经营也需要给予法律保护,否则秩序就无法得到保护,并且该罪中的生产经营不要求以营利为目的。破坏生产经营罪的“破坏”没有固定的意思,因为在我国刑法中“破坏”既可以指物理毁坏,也可以指状态改变,甚至受到不良影响等。对于本罪的其他方法,应当认定为与残害耕畜、破坏机器设备相当的破坏行为,应当包含威力和诡计。破坏生产经营罪不是目的犯,“报复泄愤或者其他个人目的”并不是本罪犯罪目的,也不是本罪与破坏生产经营罪界限要素,而仅仅是本罪的动机。故意毁坏财物罪与破坏生产经营罪并不是一般法条与特殊法条的关系,二者可以构成想象竞合。解释破坏生产经营罪的构成要件就能为该罪赋予新的生命力,规制恶意注册、恶意好评等新型的破坏生产经营的行为。
[Abstract]:The legal interests of the crime of destroying production and operation are neither property ownership nor order of production and operation, but economic interests of production and operation. The object of this crime is production and operation. Production and operation do not require the purpose of profit, illegal production and operation also need to give legal protection, otherwise order can not be protected, and the production and operation of this crime does not require profit as the purpose. The "destruction" of the crime of destroying production and operation has no fixed meaning, because in the criminal law of our country, "destruction" can not only refer to physical destruction, but also to the change of state, and even be adversely affected, etc. The other methods of this crime shall be regarded as acts of destruction which are equivalent to the killing of farm animals and the destruction of machinery and equipment, and shall contain power and cunning. The crime of destroying production and operation is not a crime of purpose, "revenge or other personal purpose" is not the purpose of this crime, nor is it the element of the boundary between this crime and the crime of destroying production and operation, but is only the motive of this crime. The crime of intentionally destroying property and the crime of destroying production and operation are not the relationship between general law and special law. Explaining the constitutive elements of the crime of destroying production and operation can give new vitality to the crime, regulate malicious registration, malicious praise and other new acts of destroying production and operation.
