论“碰瓷”行为的类型以及刑法规制

【摘要】：近年来"碰瓷"现象日益严重,越来越成为人们关注的焦点问题。而对"碰瓷"行为的定性却存在着较大分歧,实践中的处理方式也是五花八门。各类行为方式虽然都具有"碰瓷"的表象,但是其性质却各不相同。按照行为的具体犯罪构成以及被害人交付财物的根本原因进行分析,可将各类"碰瓷"行为具体分为五种类型,即敲诈勒索型、抢劫型、诈骗型、以危险方法危害公共安全型以及混合型。同时,对每一种类型的"碰瓷"进行深入分析,捋清"碰瓷"案件处理的思路,从而避免"同案不同判"现象的出现。
[Abstract]:In recent years, the phenomenon of "touching porcelain" is becoming more and more serious and has become the focus of attention. However, there are great differences on the nature of the "touch porcelain" behavior, and there are various ways to deal with it in practice. Although all kinds of behavior have the appearance of "touching porcelain", their properties are different. According to the concrete crime constitution of the behavior and the fundamental reason of the victim delivering the property, we can divide the various kinds of "touching porcelain" behavior into five types, namely, extortion type, robbery type, fraud type, and so on, which can be divided into five types, namely, extortion type, robbery type and fraud type. Endanger public safety by dangerous means, as well as mixed type. At the same time, the author makes a thorough analysis of each type of "porcelain bumping", and smoothes out the thought of handling the case of "touching porcelain" so as to avoid the phenomenon of "different judgment in the same case".
