《刑法修正案（八）》对刑罚执行的影响及反思

【摘要】：《刑法修正案(八)》自2011年5月1日正式颁布实施以来,因其是历次刑法修改中力度最强、范围最广的一次修改,无论在理论研究界还是司法实践中都产生深远而持久的影响,受到社会各界的广泛关注。其主要内容一是对有些刑罚进行了调整,二是进一步加强了刑法对民生的保护,加重了对一些严重侵犯人民群众生命安全的一些犯罪行为的处罚,这给以监狱为主的刑罚执行机关带来长远影响。《刑法修正案(八)》的颁布实施一方面它完善了我国的刑罚结构,有利于进一步惩罚和预防犯罪,维护社会的稳定和和谐；而另一方面由于它未充分考虑到我国当前刑罚执行工作的现状,与当前“给出路”的教育改造方法产生违背,过分加重了监狱等刑罚执行机关的负担,给社会埋下了新的隐患。本文拟就《刑法修正案(八)》实施对刑罚执行工作产生的影响作一些分析探讨,同时结合自身工作实践提出相关建议,以期引起大家对监狱工作的重视,对我国刑罚执行工作的进步发展尽绵薄之力。尽管随着我国全面深化改革的不断深入,国家刑事司法体系在不断完备,但刑罚体系,尤其是监狱刑罚执行工作若想真正地符合法治社会要求,体现社会之公平正义,仍然任重道远。

The main content is to adjust some penalties. The promulgation and implementation of the amendment of the criminal law (eight) has perfected the structure of our country's penalty, which is conducive to further development. Punishment and prevention of crime, maintaining social stability and harmony, on the other hand, because it does not fully take into account the current situation of the implementation of the criminal penalty in our country, and the current "way out" of the educational reform method is violated, overly aggravated the prison and other penalty execution organs burdens, and put new hidden danger to the society.
