特定关系人共同受贿犯罪主观要件应修改为“明知”

【摘要】：正从近年来查处的贿赂案件来看,越来越多的受贿者为规避法律惩处,利用职权上的便利为他人谋取利益后并不亲手收受贿赂,而是指使其近亲属等"身边人"充当"白手套",实行"曲线受贿",此类行为影响恶劣。2007年7月,最高人民法院、最高人民检察院联合发布《关于办理受贿刑事案件适用法律若干问题的意见》(以下称《意见》),明确了认定非国家工作人员构成共同受贿犯罪的基本原则,为打击国家工作人员及其"身边人"共同受贿犯罪提供了法律依据。但是,从司法实践效果来看,依据上述规定惩处国家工作人员的特定关系人共同受贿犯罪仍然存在缺陷:该规定将有"通谋"作为特定关系人构成共同受贿犯罪的主观要件,认定标准过于苛刻,在诉讼中存在证明困难。因此,需要根据该类共同
