【摘要】：随着我国经济的发展，人民生活水平的提高，我国道路基础设施建设日趋完善，汽车保有量呈几何倍数增加。一方面极大地方便了人们的出行，另一方面，随着驾驶人员的增加，各种危险驾驶行为层出不穷，严重威胁到人们的生命和财产安全。近几年因“毒驾”导致的恶性交通事故屡现报端，，引起了人们极大的关注。《刑法修正案（八）》将“醉驾”入刑，这体现了刑法的与时俱进，然而，“毒驾”的立法工作仍不尽如人意，只有在导致严重后果情况下才能得到刑法规制。理论研究和实践证明，“毒驾”的社会危害性比“醉驾”有过之而无不及。近几年来，“毒驾”引发的恶性交通事故频发，严重的危害了道路交通安全和人们的生命财产安全。有鉴于此，“毒驾”的社会危害性逐渐引起了立法部门重视和普通民众的关注，“毒驾”入刑的呼声日益高涨。但目前，我国刑法对此的直接规定尚属空白，而纵观世界其他国家，刑法都对“毒驾”做了明确的规定。本文首先介绍了毒品的基础知识，以及对人体和社会的危害性，进而分析“毒驾”在道路交通安全领域的危害性；再分析总结我国“毒驾”的高发现状；“毒驾”入刑有很多可借鉴的立法经验，例如其他国家和地区的有效做法，同时还有实行“醉驾”入刑以来的一系列司法实践活动及经验；进而结合“毒驾”自身特点和我国具体国情，对“毒驾”刑事责任的相关问题进行了讨论。
[Abstract]:With the development of our country's economy and the improvement of people's living standard, the construction of road infrastructure in our country is becoming more and more perfect, and the number of cars is increasing by geometric multiple. On the one hand, it greatly facilitates people's travel. On the other hand, with the increase of drivers, dangerous driving behaviors emerge in endlessly, which seriously threaten the safety of people's lives and property. In recent years, the vicious traffic accidents caused by "drug driving" have been reported repeatedly, which has aroused people's great concern. < Criminal Law Amendment (8) > will "drunk driving" into criminal law, which reflects the development of criminal law, however, The legislation of "drug driving" is still not satisfactory and can be regulated by criminal law only when it leads to serious consequences. Theoretical research and practice prove that drug driving is more harmful to society than drunk driving. In recent years, the vicious traffic accidents caused by "drug driving" have caused serious harm to road traffic safety and people's life and property safety. In view of this, the social harmfulness of "drug driving" has gradually aroused the attention of the legislature and ordinary people. But at present, the direct stipulation of the criminal law of our country is still blank, and throughout the world, the criminal law all has made the explicit stipulation to the "drug driving". This paper first introduces the basic knowledge of drugs, the harm to human body and society, and then analyzes the harmfulness of "drug driving" in the field of road traffic safety, and then analyzes and summarizes the current situation of high incidence of "drug driving" in China. There are many legislative experiences that can be used for reference, such as the effective practices of other countries and regions, and a series of judicial practice activities and experiences since the implementation of "drunk driving". Combining with the characteristics of "drug driving" and the specific conditions of our country, the related problems of criminal liability of "drug driving" are discussed.
