信用卡诈骗犯罪形态研究

【摘要】：信用卡作为现代社会的产物，其所具有直接消费、存款取现、大额转帐、异地汇款等大量功能，给人类的经济活动更来的巨大的革新，极大地便利了生产、经营、生活，随着信用卡的不断普及，刷卡支付已成为流行于国际社会的新型支付方式。然而，在信用卡带给我们带来诸多便利的同时，伴随而来的日渐活跃的信用卡犯罪也越来越多地危害着人们群众的财产安全。因此，我国刑法对信用卡犯罪的规定从无到有，日趋完善；其中信用卡诈骗最作为从传统诈骗罪中分离出来的一个新罪名，，在学术研究和司法实践中的不断完善及运用，更加体现了当前司法体系下对此类犯罪的重视，也是我国刑法在打击信用卡犯罪过程中不断日臻完善的重要表现。本文秉承理论研究要为司法实践服务的基本理念，对信用卡诈骗罪的犯罪形态进行研究并提出一些观点。
[Abstract]:As a product of modern society, credit card has a lot of functions such as direct consumption, deposit taking, large amount transfer, foreign remittance and so on. It has greatly facilitated the economic activities of human beings and greatly facilitated production, operation and life. With the continuous popularization of credit cards, payment of card by credit card has become a new mode of payment popular in the international community. However, while the credit card brings us a lot of convenience, the increasingly active credit card crime is becoming more and more harmful to the people's property security. Therefore, the criminal law of our country has become more and more perfect in the regulations of the credit card crime, and the credit card fraud is the most separated from the traditional crime of fraud. The continuous improvement and application of a new crime in academic research and judicial practice more embodies the importance of this kind of crime under the current judicial system. It is also an important performance of our criminal law in the process of combating credit card crime. This article is based on the basic concept of the theory research to serve the judicial practice and the credit card fraud. The crime pattern of cheat crime is studied and some viewpoints are put forward.
