【摘要】：实行行为是刑法理论中最重要的概念之一，其正确界定意义重大。近些年来，随着日本、德国刑法理论和刑法制度的不断引进，大陆法系刑法理论和刑事立法对我国刑法理论和司法实践影响日益重大，实行行为在司法定罪量刑活动中发挥的作用也越来越重要。然而，，相比较于实行行为概念的重要性，国内关于实行行为的研究还很不足，有待进一步加强。正是在这一背景下，本文产生了。本文首先在借鉴大陆法系以及英美法系关于实行行为概念定义的基础上，并结合我国刑法学者关于实行行为概念的研究，从形式与实质两个层面正确界定了犯罪实行行为的概念；其次，本文对犯罪实行行为的实质进行了进一步的探索，在深入研究危险理论相关学说的基础上，就如何判断实行行为的危险性进行了进一步的阐述；再次，本文严格区分了实行行为与构成行为、非实行行为等相关行为的异同，以免发生混淆；最后，本文简单阐述了正确界定实行行为的意义与价值，突出强调实行行为的重要性。
[Abstract]:Practice behavior is one of the most important concepts in the theory of criminal law, and its correct definition is of great significance. In recent years, with the introduction of criminal law theory and criminal law system in Japan and Germany, the criminal law theory and criminal legislation of civil law system have an increasingly important influence on the criminal law theory and judicial practice of our country. It is more and more important to carry out behavior in the activity of judicial conviction and sentencing. However, compared with the importance of carrying out the concept of behavior, domestic research on practice behavior is still insufficient and needs to be further strengthened. It is in this context that this paper emerged. First of all, on the basis of drawing lessons from the definitions of the civil law system and the common law system, and combining with the research of the criminal law scholars of our country on the concept of the practice act, This paper defines the concept of criminal practice from the two aspects of form and substance. Secondly, this paper makes further exploration on the essence of criminal practice, on the basis of deeply studying the related theories of risk theory. How to judge the risk of conduct is further elaborated. Thirdly, this paper strictly distinguishes the similarities and differences between the act of execution and the behavior of constitution, non-practice and other related acts so as to avoid confusion. This paper briefly expounds the significance and value of defining the practice behavior correctly, and emphasizes the importance of the practice behavior.
