总体社会事实与社会秩序观察——以藏族偷盗惩罚为例

【摘要】:总体社会事实为整体性观察一个社会提供了理论视角和方法。惩罚是一种总体社会事实,通过对偷盗及偷盗惩罚的观察,可以观察整体社会秩序。西藏地方政府成文法典强调对偷盗的惩罚性赔偿,这在康巴、安多等部落社会习惯法也有体现。比较成文法典与部落习惯法偷盗惩罚差异,可以发现民主改革前西藏地方政府未能在康区、安多等地的藏族部落建立起严密的统治体系。动态考察总体社会事实,也可看到社会秩序变迁,在当代藏族社会,尽管有统一的法律制度与司法程序,但是惩罚性赔偿在一些地方仍被创造性地运用。
[Abstract]:The overall social facts provide a theoretical perspective and method for the holistic observation of a society. Punishment is a general social fact. By observing the punishment of theft and theft, we can observe the whole social order. The written code of the Tibetan local government emphasizes punitive damages for theft, which is also reflected in the customary law of tribal societies such as Kangba and Ando. By comparing the differences between the written code and the customary tribal laws, it can be found that before the democratic reform, the Tibetan local government failed to establish a strict ruling system in the Tibetan tribes in Kang District, Ando and other places. In the contemporary Tibetan society, although there is a unified legal system and judicial procedure, punitive damages are still creatively applied in some places.
