拐卖妇女、儿童罪既遂标准及其认定研究

【摘要】：在刑法学界里,对拐卖妇女、儿童罪既遂形态的判断标准,学者们的争议从不间断。学者们的观点各不相同,且在司法实践中也无法很好地统一适用。因此,关于拐卖妇女、儿童罪既遂标准,本文拟对其提出自己的拙见,以期更好地在司法实践中适用。对拐卖妇女、儿童罪既遂标准的认定,本文通过本罪的相关问题进行研究和分析,进而欲得出相对合理的犯罪既遂标准。第一,拐卖妇女、儿童罪的概述。本文对本罪的构成要件要素予以具体法理分析,包括其保护的法益、实行行为、犯罪目的,明确本罪的立法含义,为确保本罪既遂犯罪标准的确立符合犯罪构成要件理论的要求。第二,本文对我国和域外关于本罪的各种既遂标准理论观点进行陈列,以充分了解我国和域外关于本罪的既遂理论研究现状,并对这些观点进行评析,指出其中观点的合理之处与不足之处,同时,本文将这些理论研究现状作为本文的既遂理论研究基点进行深入的研究。第三,我们要学习和借鉴域外关于本罪的先进理论,其次,在遵循“犯罪构成要件齐备说”犯罪既遂理论的前提下,本文对本罪既遂标准“控制说”作出部分修正以成为本罪的既遂理论标准,同时,阐述修正“控制说”既遂标准的合理性。第四,本罪的既遂标准认定问题,本文在从单独犯罪和共同犯罪的角度下,分别对具体实施本罪的既遂标准认定进行阐述。其中,单独犯罪的角度下,本文从一般拐卖行为和特殊拐卖行为这两个方面予以提出具体的既遂认定;共同犯罪的角度下,本文从简单共同犯罪和复杂共同犯罪这两个方面予以提出具体的既遂认定。
[Abstract]:In the field of criminal law, the judgment standard of the crime of trafficking in women and children is always disputed by scholars. Scholars have different views and can not be applied uniformly in judicial practice. Therefore, with regard to the standard of accomplishing the crime of abduction and trafficking of women, this paper intends to put forward its own views in order to be better applied in judicial practice. In this paper, the author studies and analyzes the crime accomplished standard of trafficking in women and children, and tries to find out a relatively reasonable standard of accomplished crime. First, an overview of the crime of trafficking in women and children. This article makes a concrete legal analysis of the elements of this crime, including the legal interests protected by the crime, the practice of the act, the purpose of the crime, and the legislative meaning of the crime. In order to ensure that the establishment of the crime accomplished crime standards meet the requirements of the theory of constitutive elements of crime. Second, this paper displays various theories of accomplishment standards of crime in China and abroad, in order to fully understand the present situation of the theory of accomplishment in China and abroad, and to comment on these views. At the same time, the present situation of these theories is taken as the basic point of this paper. Third, we should learn from and learn from the advanced theories about this crime in foreign countries. Secondly, under the premise of following the theory of "complete elements of crime", In this paper, the author makes a partial revision of the theory of accomplishment of this crime in order to make a partial amendment to the theory of accomplishment of the crime, and at the same time, expounds the rationality of the standard of accomplishment of the revised theory of control. Fourth, the crime of completion standards, this article from the perspective of individual crime and joint crime, respectively to the specific implementation of the crime of completion standards. Among them, under the angle of individual crime, this article puts forward the concrete accomplished cognizance from the two aspects of general trafficking and special trafficking; under the angle of joint crime, This article from the simple joint crime and the complex joint crime these two aspects to put forward the concrete accomplished determination.
