论刑法与行政刑法的并立

【摘要】："行政刑法"是个舶来品,一般是指行政法或经济法中的"附属刑法"。然而在我国有特殊性,一方面我国"附属刑法"呈现"附而不属"的状况,没有实质性的罪刑规范,即没有罪名和法定刑这些实质内容;另一方面我国在刑法之外规定有大量的人身自由罚,也即行政处罚中有行政拘留、收容教养、强制戒毒等,而且这些人身自由罚没有司法程序。加之我国刑法既定性又定量的构罪标准,导致我国行政法与刑法不能够进行有效衔接。故本文主张建立刑法"二元立法机制",实行刑法和行政刑法的并立,从根本上解决我国长期以来行政执法与刑事司法衔接难的问题,以推动我国刑法的科学立法。
[Abstract]:"Administrative Criminal Law" is an exotic, generally refers to administrative law or economic law "subsidiary Criminal Law". However, there are particularities in our country. On the one hand, the subsidiary Criminal Law of our country presents the condition of "attaching but not belonging to", and there are no substantive norms of crime and punishment, that is, no charge and statutory punishment. On the other hand, our country stipulates a large number of personal liberty punishment outside the criminal law, that is, the administrative punishment includes administrative detention, institutionalization, compulsory detoxification and so on, and there is no judicial procedure for these personal liberty punishment. In addition, the established and quantitative standard of crime construction in criminal law of our country leads to the inability of effective connection between administrative law and criminal law. Therefore, this paper advocates the establishment of "dual legislative mechanism" of criminal law, the implementation of the criminal law and the administrative criminal law, fundamentally solve the problem of the link between administrative law enforcement and criminal justice for a long time in our country, in order to promote the scientific legislation of criminal law in our country.
