刑事责任根据新论

【摘要】：刑事责任根据亘古而事关重大,相继产生的道义责任根据论、社会责任根据论、心理责任根据论、规范责任根据论和人格责任根据论,其实质都是关于理智责任根据的理论。刑事责任产生的原因可以划分为根据和条件,刑事责任的根据是行为人的犯罪心理,它包括罪过心理部分和非罪过心理部分,而犯罪的主体要件、客体要件、客观要件等只是刑事责任产生的条件。刑事责任根据可分为着眼于预防的根据和着眼于惩罚的根据;亦可分为理性犯罪的刑事责任根据和非理性犯罪的刑事责任根据。
[Abstract]:The theory of moral responsibility, social responsibility, psychological responsibility, normative responsibility and personality responsibility are all theories of rational responsibility. The causes of criminal responsibility can be divided into bases and conditions. The basis of criminal responsibility is the criminal psychology of the perpetrator, which includes the criminal psychology and non-sin psychology, while the subject and object elements of the crime. Objective elements and so on are only the conditions for the emergence of criminal responsibility. The basis of criminal responsibility can be divided into the basis of prevention and punishment, the basis of criminal responsibility of rational crime and the basis of criminal responsibility of irrational crime.
