期待可能性理论比较研究

【摘要】：期待可能性理论起源于德国，在引入日本后得到了长足的发展。我国对于期待可能性理论的研究起步较晚，，但经过我国刑法学者们三十余年的不断探寻，也逐渐形成了一些成熟的理论成果。期待可能性理论之所以能够引起我国刑法学界的广泛研究兴趣，在于其内在所含的浓浓人性意味，在将其引入我国刑法领域后对我国的刑事立法、司法等方面都有着重要的意义。本文意在通过对期待可能性进行历史探寻，并从哲学、伦理学角度开展有效分析，在对期待可能性的相关问题有一定认知的基础上，将期待可能性理论与我国立法、司法情况相结合，就如何将期待可能性更好融入我国刑法体系作出构想。以其内在精神价值对我国刑事立法、司法产生积极影响，发挥其应有之功效。
[Abstract]:The theory of expectant possibility originated in Germany and developed greatly after it was introduced into Japan. The research on the theory of expectation possibility started late in our country, but after more than 30 years' continuous exploration by the scholars of criminal law in our country, some mature theoretical achievements have been gradually formed. The reason why the theory of expectation possibility can arouse the extensive research interest of the criminal law circles in our country lies in the deep human nature connotation inherent in it, the criminal legislation of our country after introducing it into the criminal law field of our country. Judicial and other aspects are of great significance. The purpose of this paper is to make a historical exploration of the possibility of expectation, and carry out an effective analysis from the angle of philosophy and ethics, and on the basis of a certain cognition of the relevant issues of the possibility of expectation, we will combine the theory of the possibility of expectation with the legislation of our country. How to integrate the expected possibility into the criminal law system of our country is proposed. With its inner spiritual value, it has a positive influence on our criminal legislation and judicature, and exerts its due effect.
