性别保护视角下强奸罪的反思与重构

【摘要】：我国刑法采取传统性别模式评价性侵犯罪,在应对新型性侵犯罪方面存在一定的滞后性。通过对刑法法意和性权益保护方式的分析,发现由于受制于单一性别模式,强奸罪立法规定存在不足,具体体现在法益保护、犯罪行为方式、犯罪主体对象划定、涉性犯罪的概念位阶等的规定不周延,以及罪名体系不统一方面。强奸罪的立法完善应从三个方面进行:取消强奸罪的性别限制;扩大强奸罪行为方式;强调对不同性别人群的性权利予以同等保护,从而实现对不同类型性侵犯罪行为的有效规制。
[Abstract]:China's criminal law adopts the traditional gender model to evaluate the sexual assault crime, which has some lag in dealing with the new sexual assault crime. Through the analysis of the meaning of criminal law and the way of protecting sexual rights and interests, it is found that the legislative provisions of the crime of rape are insufficient because of being restricted by a single gender model, which are embodied in the protection of legal interests, the mode of criminal conduct, and the delineation of the object of the subject of the crime. The definition and rank of sexual crimes are not comprehensive, and the charge system is not uniform. The legislative improvement of rape crime should be carried out in three aspects: abolishing the sex restriction of rape crime; expanding the behavior mode of rape crime; emphasizing the equal protection of sexual rights of different sex groups.
