亲属关系对亲属犯罪定罪量刑的影响——以人身权犯罪为例

【摘要】：亲属犯罪指的是亲属之间发生的侵害人身权利、财产权利的犯罪,本文仅针对亲属间人身权犯罪进行探讨。亲属间人身权犯罪不但侵犯了亲属的人身权利,而且对家庭伦理道德也是一次巨大的冲击,笔者认为这种犯罪的社会影响力更加恶劣,应当对其采取不同于常人的刑罚,不能一概而论。但从我国现行刑法来看,对这方面并未重视,犯罪成本低造成亲属人身权犯罪更加猖獗。为了维护法治尊严、社会稳定、家庭和睦,对亲属人身权犯罪作出特别规定具有积极意义。
[Abstract]:The crime of kinship refers to the crime of infringing upon personal right and property right between relatives, this article only discusses the crime of personal right among relatives. The crime of personal rights among relatives not only infringes upon the personal rights of relatives, but also has a great impact on family ethics and morality. The author thinks that the social influence of this crime is even worse, which should be punished differently from ordinary people. One cannot generalize. But from the point of view of the current criminal law of our country, we do not attach importance to this aspect, and the low cost of crime makes the crime of personal rights of relatives more rampant. In order to maintain the dignity of the rule of law, social stability and family harmony, it is of positive significance to make special provisions on the crime of personal rights of relatives.
