危害药品安全犯罪问题研究

【摘要】：药品作为一种特殊的商品,它的安全与人的生命、健康紧密相关,是社会公众十分关注的民生问题。本文以近三年B市C区办理的危害药品安全犯罪为样本,分析了此类案件的特点,探讨了假药、劣药的认定,生产、销售假药罪的入罪标准,以及主观罪过如何认定等问题。
[Abstract]:As a special commodity, drug safety is closely related to human life and health. Taking the crime of endangering drug safety handled in area C of B city in recent three years as the sample, this paper analyzes the characteristics of this kind of case, probes into the identification of counterfeit medicine, the identification of inferior medicine, the standard of incriminating crime of producing and selling counterfeit drugs, and how to determine the subjective sin, and so on.
