组织淫秽表演罪定性问题研究
[Abstract]:During his graduate studies, the author was fortunate to participate in a series of research topics about the crime of pornography, gambling and drugs on his mentor's desk. Since April 2013, the author has focused on the crime of obscene articles in Chapter 6, Section 9 of the Criminal Law. In the course of collecting materials and reading through the materials, the author has learned a lot of typical cases, and has also noticed that the provisions of article 365 of the Criminal Law for organizing obscene performances are simple, and there are few relevant judicial interpretations and research documents. There are still more doubts about the application of some new forms of crime. Although this crime belongs to the crime of obscenity in the sixth chapter and the ninth section of the criminal law, there is a difference between obscene performance and obscene material, so it is impossible to apply the judicial explanation of obscene material. Therefore, in the process of thinking, the author has more and more strong interest in Article 365 of Criminal Law, and finally determines this as the topic of graduation thesis. Article 365 of the present Criminal Law stipulates: "whoever organizes pornographic performances shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance, and concurrently be sentenced to a fine; if the circumstances are serious, the offender shall be sentenced to fixed-term imprisonment of not less than three years and not more than ten years, and shall also be sentenced to a fine." This article lays down the penalty for organizing obscene performance, and makes no mention of the description of the crime of organizing obscene performance. As a result, judicial practice in dealing with some of the more advanced forms of obscenity in society, will always lead to controversy large and small. For example, the actors use the mystery and subjectivity of art and religion to pollute the social atmosphere by doing inferior things in the name of sanctity. The decriminalization of art and religious culture, such as the umbrella for such acts, makes the law always face a dilemma between public rights and private rights. Once it breaks out, it will cause social fluctuation. When the law is applied, the problem of the number of crimes can not be unified. If the doer borrowed the convenience of digital network information, directly through the network dissemination of information of vulgar taste, and profit from it. Whether the extension of the crime of organizing obscene performance can extend to the behavior of online naked chat breaking through the traditional performance mode is also controversial. In a word, the article 365 of criminal law is too simple, in solving the case of traditional organization of obscene performance, there is Yu Li, but in the face of modern society, the criminal form is vague and broad. This paper tries to analyze the qualitative limits of the crime of organizing obscene performance, the relationship between the crime and the other crime, and its maximum extension from the three cases in which the nature of the crime is controversial. There are four chapters in this paper. The first chapter summarizes the legislative purport and evolution of the crime of organizing obscene performance, and puts forward three new types of the crime of organizing obscene performance in the following three chapters. The second chapter takes the case of "Chengli Behavioral Art" as an example to discuss the possible limits of several kinds of obscene performance and performance art. At the same time, the author concludes the limits of obscene performance and behavioral art. The third chapter takes the crime of organizing obscene performance by Cai as an example to discuss the relationship between the crime of organizing obscene performance and other similar charges. Then discusses the crime number of the phenomenon of "group pat" and "private racket". The fourth chapter takes the case of "the crime of organizing obscene performance by using network chat room" as an example, discusses the application of organizing obscene performance crime to network naked chat with the method of classification and qualitative, and obtains the maximum extension of organized obscene performance crime. Through the discussion of these four chapters, this paper hopes to provide a way of thinking for the perfection of this crime, and to provide some valuable reference for the qualitative problems of the crime of organizing obscene performance in practice.
