论涉众型经济犯罪案件中的维权——以与维稳的衡平为视角

【摘要】：涉众型经济犯罪是从维稳角度提出的概念,是涉及众多经济利益受损群体,可能影响社会稳定的经济犯罪行为。涉众型经济犯罪案件中的权利包括参与人在涉足该类案件前的财产权利即原权利和利益受损群体寻求救济的权利即派生权利。要做到精确维权和依法维权,必须明确原权利维权主体的范围,明确国家机关的辅助维权地位。要鼓励利益受损群体通过法律规定的方式维权,制裁和避免极端的维权方式。要正确认识维权与维稳的关系,正确看待政府在维权过程中的作用,对现行"先刑事后民事"的法律制度进行完善,同时实现维权与维稳法律效益。
[Abstract]:The concept of stakeholder economic crime is put forward from the point of view of maintenance stability. It is a kind of economic crime that involves a large number of groups with damaged economic interests and may affect social stability. The rights in the cases of stakeholder economic crimes include the property rights of the participants before they set foot in such cases, that is, the original rights and the rights of the injured groups to seek relief, that is, the derived rights. In order to protect rights accurately and according to law, we must define the scope of the main body and the auxiliary position of the state organs. The injured groups should be encouraged to protect their rights in the way prescribed by law, sanction and avoid extreme ways of safeguarding their rights. It is necessary to correctly understand the relationship between safeguarding rights and maintaining stability, treat correctly the role of the government in the process of safeguarding rights, perfect the current legal system of "first criminal and then civil", and at the same time realize the legal benefits of safeguarding rights and maintaining stability.
