论判定犯罪轻重的标准

【摘要】：犯罪轻重实际上具有实践形态、价值形态和规范形态三种存在状态,三种形态之间未必一致与吻合。与三种形态对应的是判定犯罪轻重的三种标准:实践标准、理论标准和规范标准,其中实践标准是判定犯罪轻重的首要准则,对理论标准和规范标准具有指引与评价作用。探索实践标准可以通过围绕犯罪轻重影响因子设置各种不同变量实验方案来实现,而最终确定实验结果的科学与否,则要其经历社会公众认同、学者修正和国家司法实践检验的过程。
[Abstract]:In fact, the degree of crime has three existing states: practice form, value form and normative form, and the three forms may not be consistent with each other. What corresponds to the three forms is the three standards of judging the seriousness of crime: practice standard, theory standard and standard, among which the practice standard is the primary criterion for judging the seriousness of crime, which has the function of guidance and evaluation to the theoretical standard and standard. To explore practical standards can be achieved by setting up various variable experimental schemes around the factors affecting the severity of crime, and ultimately determining whether the results of the experiment are scientific or not, it is necessary for them to experience social and public approval.
