认罪悔罪制度的反思与重构

【摘要】：认罪悔罪制度是我国刑法体系的重要内容,在预防和惩治犯罪,促进罪犯改过自新等方面发挥积极作用。但目前认罪悔罪制度的应用仍然存在一些问题与不足,应该结合具体需要采取改进和完善措施。文章结合刑法和刑事诉讼法的基本内容,就认罪悔罪制度进行探讨分析,指出存在的不足,并提出完善对策。
[Abstract]:The system of confession and repentance is an important part of our criminal law system, which plays an active role in preventing and punishing crimes and promoting the reform of criminals. However, there are still some problems and shortcomings in the application of the system of confession and repentance, which should be improved and perfected according to the specific needs. Combined with the basic contents of criminal law and criminal procedure law, this paper discusses and analyzes the system of confession and repentance, points out the shortcomings and puts forward some countermeasures.
