论“恶势力”的法律规制

【摘要】：2006年2月,中央根据当时社会治安形势,审时度势,决定在全国范围内开展打黑除恶专项斗争,将铲除恶势力作为专项斗争主要目标,以期通过专项斗争,建立健全打黑除恶工作长效机制。全国“打黑除恶专项斗争领导小组办公室”(以下简称“打黑办”)作为全国唯一的“恶势力”评审机构,负责对全国各地每年上报数以万计的“恶势力”材料进行审核。目前此项工作存在以下的问题：一、黑社会性质组织案的审判机关可以为基层法院,然恶势力的评审机关却为国家机关层面的全国“打黑办”；二、全国“打黑办”大部分审核人员为各地公安、检察院、法院临时借调的工作人员,对恶势力标准认识不一。导致打击恶势力工作即无法充分体现社会效果、也无法体现法律效果。本文试图从恶势力的组织特征、经济特征、公开性特征、行为特征出发,对恶势力的认定标准进行规范界定提出个人见解,以期能对建立健全打黑除恶工作长效机制提供参考。本文除引言和结语外,共分三部分。第一部分首先阐释何谓恶势力,并我国2006年打黑除恶专项斗争以来,在打击恶势力工作历程及现实意义。第二部分从恶势力组织、经济、行为、公开性等四个特征出发,对恶势力的界定提出参考性意见。第三部分从有效铲除恶势力犯罪滋生蔓延的土壤、遏制恶势力组织犯罪发展势态浅议对恶势力犯罪立法的意义。
[Abstract]:In February 2006, according to the social security situation at that time and judging the situation, the Central Committee decided to launch a nationwide special struggle to crack down on criminal elements and eradicate evil forces as the main objective of the special struggle, with a view to adopting a special struggle. Establish and improve the long-term mechanism for cracking down on crime and eliminating evil. The Office of the National leading Group for the "Special struggle to fight against and eradicate evil" (hereinafter referred to as the "Anti-triad Office"), as the country's sole "evil force" evaluation body, is responsible for examining and approving tens of thousands of "evil forces" materials reported annually by all parts of the country. At present, there are the following problems in this work: first, the trial organ of the underworld organization case can be the basic court, but the judging organ of the evil force is the national "fighting criminal affairs" at the level of the state organ; Second, most of the examiners of the "crackdown on criminal affairs office" throughout the country are personnel temporarily seconded by local public security officers, procuratorates, and courts, and have different understanding of the standards of evil forces. As a result, the work of cracking down on evil forces can not fully reflect the social effect, nor can it reflect the legal effect. Based on the organizational, economic, open and behavioral characteristics of evil forces, this paper tries to put forward personal opinions on the criterion of identifying evil forces, in order to provide a reference for establishing and perfecting the long-term mechanism of fighting evil forces and eliminating evil forces. In addition to the introduction and conclusion, this article is divided into three parts. The first part first explains what evil forces are, and since 2006, China has been fighting against evil forces in the course of work and practical significance. The second part, from the four characteristics of organization, economy, behavior and openness of evil forces, puts forward some suggestions on the definition of evil forces. The third part discusses the significance of crime legislation of evil forces from effectively eliminating the soil of the breeding and spreading of evil forces' crimes and containing the developing situation of evil forces' organized crimes.
