我国环境权益的刑法保护研究

【摘要】：经济的快速发展在满足人类各种需求、给予人们各种便利的同时,也带来了许多问题,其中涉及范围最广、影响最大的就是环境问题。世界范围内频发的环境危害事件,严重损害了环境权益,引起了世界各国对环境问题和环境权益保护问题的高度重视。由于传统的行政手段和民事手段存在一些问题,导致它们面对愈演愈烈的环境危机时无法予以有效管控,因此刑法手段开始引起人们的关注,以保护环境权益为目的的环境刑法逐渐蓬勃发展起来。本文首先分析探讨了环境权益、环境犯罪的定义等基本问题,并对刑法介入环境权益保护的必要性以及环境权益刑法保护的历史发展与现状进行了论述,之后指出了我国环境权益刑法保护在立法理念、刑罚适用原则和具体制度方面存在的缺陷和问题,然后对域外主要国家和地区的环境权益刑法保护进行了比较研究,最后提出了完善我国环境权益刑法保护的设想。
[Abstract]:The rapid development of economy not only satisfies all kinds of human needs, but also brings a lot of problems, including the most extensive scope and the greatest impact on the environment. The frequent occurrence of environmental hazards in the world has seriously damaged the environmental rights and interests, and has caused great attention to the environmental problems and environmental rights and interests protection in the world. Because there are some problems in the traditional administrative and civil means, they can not be effectively controlled in the face of the increasingly fierce environmental crisis. Therefore, the criminal law means begin to arouse people's attention. Environmental criminal law, which aims to protect environmental rights and interests, is developing vigorously. This paper first analyzes and discusses the basic problems of environmental rights and interests and the definition of environmental crime, and discusses the necessity of criminal law intervention in the protection of environmental rights and interests, as well as the historical development and present situation of the protection of environmental rights and interests in criminal law. Then it points out the defects and problems of the criminal law protection of environmental rights and interests in our country in the aspects of legislation idea, applicable principle of penalty and specific system, and then makes a comparative study on the criminal law protection of environmental rights and interests of the main countries and regions outside the country. Finally, the author puts forward the idea of perfecting the criminal law protection of environmental rights and interests in our country.
