终身监禁新规法理争议问题论要

【摘要】：《刑法修正案(九)》中增设的贪污受贿犯罪之死缓犯终身监禁制度具有替代死刑立即执行和严肃惩治严重腐败犯罪之双重功能,其属于依附于死缓制度而存在、刑罚严厉性介于死刑立即执行与一般死缓之间的死缓执行方式。依据修订前《刑法》规定应判处死刑立即执行还是应判处死缓来判断终身监禁新规是否具有溯及力较为科学。现阶段被判处终身监禁的死缓犯不能适用关于重大立功的规定,未来立法修改时,基于促进犯罪分子的教育改造和发挥终身监禁的制度优势之考量,可考虑对其增补适用重大立功的规定。对相关制度的改革应综合考虑死刑改革的大局,审慎扩大死缓犯终身监禁制度的适用范围。
[Abstract]:The system of life imprisonment for the crime of corruption and bribery added in the Amendment to the Criminal Law (9) has the dual function of replacing the death penalty immediately and severely punishing serious corruption crimes, and it belongs to the system of suspension of death penalty. The severity of punishment is between the immediate execution of the death penalty and the general reprieve of death penalty. It is more scientific to judge whether the new rule of life imprisonment has retroactive effect according to the Criminal Law before revision whether the death penalty should be executed immediately or the death penalty should be suspended. At this stage, the suspended offender sentenced to life imprisonment cannot apply the provisions on major meritorious service. When the future legislation is amended, it is based on the consideration of promoting the educational reform of criminals and giving full play to the advantages of the system of life imprisonment. Consideration may be given to the addition of provisions for major meritorious service. The reform of relevant system should consider the overall situation of death penalty reform and expand the scope of application of life imprisonment system.
