一起互联网金融欺诈典型案例的启示

【摘要】:正随着互联网金融快速发展,不法分子针对银行客户的欺诈犯罪更加猖獗,作案手段不断"升级换代",并且表现出高科技化、专业化、隐蔽化等特点。由于公安机关破案率低且向不法分子追偿的可能性较小,大量受损客户往往以未尽到安全保障义务为由投诉银行。加上调查取证比较困难、涉案金额相对较高且协商余地小,导致妥善化解此类诉求的难度很大。为妥善处理此类投诉问题,本文拟通过一起互联网金融欺诈案例,详细分析投诉反映的相关风险问题,从完善外部欺诈风险管控体系,健全消费者信息保护管理机制,增强消费者互联网金融安全意识等多个维度,有针对性地提出有关工作建议。
[Abstract]:With the rapid development of Internet finance, the criminals' fraud crimes against bank customers are more rampant, the means of committing crimes are constantly "upgraded", and they show the characteristics of high technology, specialization, concealment and so on. Due to the low detection rate of public security organs and the small possibility of recovering compensation from lawbreakers, a large number of injured customers often complain about the banks by failing to fulfill their obligations of safety and security. In addition, the investigation and evidence collection is more difficult, the amount of money involved is relatively high and the room for negotiation is small, which leads to the difficulty of properly resolving such claims. In order to deal with this kind of complaint problem properly, this paper intends to analyze the related risk problems reflected in the complaint in detail through an Internet financial fraud case, from perfecting the external fraud risk control system, perfecting the consumer information protection management mechanism, Enhance consumers' awareness of Internet financial security and other dimensions, and put forward relevant work suggestions.
