环境污染犯罪案件存在的问题与对策

【摘要】：随着城镇化建设迅速发展,环境问题不容小觑。自2013年6月8日《最高人民法院、最高人民检察院关于办理环境污染刑事案件适用法律若干问题的解释》实施以来,环境污染类刑事案件日趋规范化、程序化,此类案件在数量上也呈上升趋势。此类案件不仅关乎国计民生,也涉及到刑事司法与环境保护等部门在工作机制上的相互衔接以及配合,应引起高度重视。本文以笔者所在区检察院近年来受理的环境污染类案件为切入点,深度剖析当前打击污染环境犯罪存在的问题与困难,并提出合理化建议,以期达到严惩环境污染违法犯罪行为,切实维护人民群众环境合法权益的目的。
[Abstract]:With the rapid development of urbanization, environmental problems should not be underestimated. Since the implementation of the Supreme people's Court and the Supreme people's Procuratorate on June 8, 2013, concerning the legal issues applicable to the handling of environmental pollution criminal cases, the criminal cases of environmental pollution have become more and more standardized and programmed. The number of such cases is also on the rise. Such cases are not only related to the national economy and people's livelihood, but also to the mutual connection and cooperation between the criminal justice and environmental protection departments in the working mechanism, which should be attached great importance to. Based on the environmental pollution cases accepted by the district procuratorate in recent years, this paper analyzes in depth the problems and difficulties existing in cracking down on the crime of polluting the environment, and puts forward some reasonable suggestions. In order to severely punish illegal and criminal acts of environmental pollution and protect the people's legitimate rights and interests of the environment.
