军队贪利型职务犯罪案件侦防对策研究

【摘要】：近年来，随着改革开放的持续深入以及地方社会不良风气的影响，腐败正在从地方社会向军队蔓延。伴随新一届政府在地方社会所掀起的反腐风暴，军队腐败进一步为民众所关注。人民军队肩负着保家卫国的重任，是构建国家安全的重要基石，在国家核心利益面对挑战时，一支腐败的军队必然辜负国民的期待，损害人民军队的良好形象。本文在论述军队腐败时抓住其本质，创造性的引用军队贪利型职务犯罪的概念，对该类犯罪的特点、原因、危害等进行理论的探讨，提出有军队特色的侦查方法及措施，并着力构建行之有效的犯罪防控体系。本文除引言外，共分为三个部分。第一部分为军队贪利型职务犯罪案件概述。通过定义军队贪利型职务犯罪案件的相关概念，结合军队特色阐述了军队贪利型职务犯罪案件的特点，，最后分析了军队贪利型职务犯罪案件高发的原因以及危害。第二部分为军队贪利型职务犯罪案件的侦查策略。首先论述了该类犯罪的侦查特点和侦查困境，说明侦办此类犯罪案件的困难。其次，为了突破侦查“瓶颈”，进一步阐述了以涉案相关人员、搜查、查账、技术手段为侦查突破口的选择途径。最后，提出了军队贪利型职务犯罪案件的宏观侦查策略以及具体的侦查措施，在宏观与微观两方面采取适合军队特色的措施，如为案件侦查工作营造良好的氛围，探索拓宽线索来源渠道，强化情报共享，强化证据意识，提高取证能力等方面。第三部分为军队贪利型职务犯罪案件防范对策。该部分主要从加强教育、强化制度建设、权力制约与监督、从严惩治、提高军人待遇、借鉴外军经验以及技术预防六个方面来构建军队贪利型职务犯罪的防控体系。
[Abstract]:In recent years, with the continuous deepening of reform and opening up and the influence of bad local social atmosphere, corruption is spreading from the local society to the army. With the new government in the local society set off a storm of corruption, military corruption has been further concerned by the public. The people's army shoulders the important task of defending the country and is the important cornerstone of constructing the national security. When the core interests of the country face the challenge, a corrupt army will inevitably fail the expectation of the people and damage the good image of the people's army. This paper discusses the essence of military corruption, inventively cites the concept of military profit-type duty crime, probes into the characteristics, causes and harms of this kind of crime, and puts forward the investigation methods and measures with military characteristics. And try to build an effective crime prevention and control system. In addition to the introduction, this paper is divided into three parts. The first part is the summary of the crimes of military embezzlement. By defining the relevant concepts of military job-related crimes, combining with the characteristics of the army, this paper expounds the characteristics of military job-related crimes, and finally analyzes the causes and hazards of the high incidence of military job-related crimes. The second part is the investigation strategy of the duty crime cases of military corruption. Firstly, it discusses the investigation characteristics and difficulties of this kind of crimes, and explains the difficulties of investigating such crimes. Secondly, in order to break through the "bottleneck" of investigation, this paper further expounds the choice way of breakthrough in investigation with related personnel, search, check accounts and technical means. Finally, the paper puts forward the macroscopic investigation strategy and the concrete investigation measures of the military embezzlement type duty crime cases, and adopts the measures suitable for the military characteristics in the macro and micro aspects, such as creating a good atmosphere for the investigation of the cases. To explore ways to broaden the sources of clues, strengthen the sharing of information, strengthen the awareness of evidence, improve the ability to obtain evidence. The third part is the prevention countermeasures of the military corruption-type duty crime cases. This part mainly from strengthening education, strengthening system construction, power restriction and supervision, strict punishment, improving the treatment of servicemen, drawing lessons from foreign military experience and technical prevention to construct the prevention and control system of military corruption type duty crime.
