电信诈骗犯罪防控研究

【摘要】：电信诈骗犯罪主要是通过利用手机、小灵通、固定电话、VOIP电话、网络等通讯工具，以非法占有他人财物为目的，采取虚构事实或者隐瞒事实真相的方法，骗取较大数额公私财物的行为。目前我国电信诈骗犯罪已成为社会的一大公害，并伴随着经济的发展、科技的进步而打击难度逐渐递增。基于这样的一个考虑，文章对电信诈骗犯罪展开了研究，从电信诈骗犯罪的基本理论出发分析了当前电信诈骗犯罪常见的几种类型及其特点；而其中具有代表性的类型有电话欠费诈骗、刷卡消费诈骗、退税退款诈骗、虚假中奖诈骗、虚构救济诈骗、冒充领导诈骗、高薪招聘诈骗等；其特点主要呈现出犯罪手段的多样化、手段隐蔽、查控困难、犯罪团伙化、集团化、涉案范围越来越广。就电信诈骗犯罪的现状而言，，其犯罪的广泛性也导致了电信诈骗犯罪管辖混乱、侦破难度大、追缴赃款难度大、打击处理难、案件侦破获取证据难；其发展趋势也呈现出了犯罪对象特定与不特定相结合、犯罪手段和技术手段更新快、高压打击下诈骗有所收敛、跨国犯罪增多等。文章在对打击和预防电信诈骗犯罪的对策上重点从立法、加强公安打击方面、完善社会相关部门规范及个人自我保护等方面进行了展开，认为在立法上应该完善相关的立法、完善个人信息的相关法律、电信、互联网、银行等相关行业的法律有待于完善；在加强公安机关的打击防范力度方面应该加强对行业的业务知识培训、加强教育宣传，及时公布典型案例、新型作案方式、加强对电信诈骗犯罪分子的打击力度；在完善社会相关方面规范上应该加强相关行业的监管，如完善银行业方面的监管、完善电信业方面的监管、完善互联网方面的监管；在加强被害人的防范能力方面应该注重加强自我认识，提高自我防范能力、注重个人信息的安全、加强学习，提高对电信诈骗犯罪的认识以及完善国际方面之间的合作等。
[Abstract]:The crime of telecom fraud is mainly through the use of mobile phone, PHS, fixed telephone, VOIP telephone, network and other means of communication, with the aim of illegally possessing other people's property, adopting the method of fabricating or concealing the truth of the fact. The act of defrauding a large amount of public or private property. At present, the crime of telecom fraud has become a public hazard in our country, and with the development of economy and the progress of science and technology, the difficulty of cracking down is increasing gradually. Based on this consideration, this paper studies the crime of telecom fraud, and analyzes the common types and characteristics of telecom fraud crime from the basic theory of telecom fraud crime. The typical types are telephone charge fraud, credit card fraud, tax refund fraud, false lottery fraud, fictional relief fraud, fake leadership fraud, high salary recruitment fraud and so on. Its characteristics mainly show the diversification of criminal means, covert means, difficulty in investigation and control, gang crime, collectivization, and the scope of involvement is more and more extensive. As far as the present situation of telecom fraud crime is concerned, the universality of the crime also leads to the confusion of the jurisdiction of the telecom fraud crime, the difficulty of detection, the difficulty of recovering the stolen money, the difficulty of dealing with the attack, and the difficulty of obtaining the evidence for the case detection. Its development trend also presents a combination of specific and non-specific crime object, crime means and technical means to update quickly, high-pressure crackdown fraud convergence, transnational crime increase and so on. The article focuses on the countermeasures to combat and prevent the crime of telecom fraud from the aspects of legislation, strengthening the public security crackdown, perfecting the norms of the relevant social departments and personal self-protection, etc., and holds that the relevant legislation should be perfected in the legislation. Improve the personal information of the relevant laws, telecommunications, Internet, banking and other related industries need to be improved; In the aspect of strengthening the strike and prevention of the public security organs, we should strengthen the training of professional knowledge, strengthen the education and publicity, publish the typical cases in time, new ways of committing crimes, and strengthen the crackdown on the criminals of telecom fraud. We should strengthen the supervision of related industries, such as banking supervision, telecommunications supervision and Internet supervision. In the aspect of strengthening the prevention ability of victims, we should pay attention to strengthening self-awareness, improving self-prevention ability, paying attention to the security of personal information, strengthening study, improving the understanding of the crime of telecom fraud and perfecting the international cooperation.
