论生产、销售不符合安全标准的食品罪及其立法完善

【摘要】:近年来,我国食品安全事故层出不穷,不仅造成社会公众对食品安全的极度不信任,还极大地损害了国家的形象。食品安全事故之所以屡禁不止,原因在于食品生产经营者为了牟取暴利而罔顾道德底线,同时也反映出我国食品监管不力、法律规制缺失等问题。为此,国家相继完善了食品安全法律法规,以加大对危害食品安全犯罪的打击力度。然而,由于立法技术和其他因素所致,,我国食品安全刑事立法还存在着在一定的缺陷,比如刑法分则体系中归属不当、罚金刑的规定不合理、缺乏对本罪过失形态的规制等等。本文结合《刑法修正案(八)》和《最高人民法院、最高人民检察院关于办理危害食品安全刑事案件适用法律若干问题的解释》(以下简称《解释》)的最新内容,从生产、销售不符合安全标准的食品罪(以下简称本罪)的基本理论入手,通过考察域外国家的食品安全犯罪立法,深入分析我国现行立法中存在的不足,并在此基础上,为相关的立法提出一些完善建议。 全文内容分为四个部分: 第一部分,阐述了本罪的相关理论,比如本罪的定义及特征,与相关罪名的界限等等。 第二部分,通过对美国和意大利食品安全犯罪立法的考察,分析其各自的特点,从中总结出能为我国立法所借鉴的经验。 第三部分,通过对我国现行立法的分析,提出本罪在立法上存在的一些不足,如在刑法分则体系中归属不当、罚金刑的规定不合理、缺乏对本罪过失形态的规制。 第四部分,针对本罪存在的不足,提出将本罪纳入到危害公共安全罪中、明确罚金刑的适用标准、增设过失生产、销售不符合安全标准的食品罪以及增设本罪资格刑的设想。
[Abstract]:In recent years, food safety accidents in China have emerged one after another, which not only leads to public mistrust of food safety, but also greatly damages the image of the country. The reason why food safety accidents are prohibited repeatedly is that food producers and operators ignore the moral bottom line in order to make huge profits. At the same time, they also reflect the problems such as inadequate food supervision and lack of legal regulation in our country. To this end, the state has improved food safety laws and regulations one after another, in order to strengthen the fight against food safety crimes. However, due to the legislative technology and other factors, there are still some defects in the criminal legislation of food safety in our country, such as improper attribution in the system of sub-rules of criminal law, unreasonable provisions of fine penalty, lack of regulation on the form of negligence of this crime, and so on. This article combines the latest contents of the Criminal Law Amendment (8) and the interpretation of the Supreme people's Procuratorate, on several issues concerning the application of the law in handling criminal cases against food safety (hereinafter referred to as the "interpretation"), from the point of view of production, Starting with the basic theory of selling food crimes which do not meet the safety standards (hereinafter referred to as this crime), by examining the food safety crime legislation of the countries outside the territory, this paper deeply analyzes the shortcomings in the current legislation of our country, and on this basis, Put forward some perfect suggestions for the relevant legislation. The full text is divided into four parts: the first part, elaborated the related theory of this crime, such as the definition and characteristics of this crime, and the boundary of related charges and so on. The second part, through the investigation of the legislation of food safety crime in America and Italy, analyzes their respective characteristics, and summarizes the experience that can be used for reference in the legislation of our country. The third part, through the analysis of the current legislation of our country, puts forward some deficiencies in the legislation of this crime, such as improper attribution in the criminal law system, unreasonable provisions of the fine penalty, and lack of regulation on the fault form of this crime. In the fourth part, according to the shortcomings of this crime, the author puts forward the assumption that the crime should be included in the crime of endangering public safety, the applicable standard of fine penalty should be defined, the negligent production should be added, the food crime which does not meet the safety standard should be sold, and the qualification penalty of this crime should be added.
