网络诈骗犯罪现状及对策研究

【摘要】：随着社会经济的快速发展,网络诈骗犯罪也呈现上升趋势,成为网络犯罪的中最值得关注的问题之一。明确网络诈骗犯罪的概念、特征、表现形式,深入了解网络诈骗犯罪的立法现状,以及司法实践中存在的问题,探究预防和控制网络诈骗犯罪的各种有效对策,这对于完善我国网络诈骗犯罪的刑事立法,为打击网络诈骗犯罪司法实践具有重要的作用,对于保障广大网民的财产安全和维护良好的网络秩序同样具有重要意义。除引言与结论之外,文章分四个部分进行阐述:第一部分,首先从犯罪学角度论述网络诈骗犯罪的定义即:以非法占有为目的,利用互联网虚构事实或者隐瞒真相,骗取数额较大的公私财物,严重危害社会的行为在解释网络诈骗犯罪的概念基础上,又分析网络诈骗的特征:跨时空性、极强的隐秘性、呈产业化发展趋势。分析网络诈骗产生的原因及典型表现形式。第二部分,主要梳理网络诈骗犯罪的立法现状,阐明我国《刑法》打击计算机犯罪的规定虽然初具体系,但是规定过于笼统宽泛,没有单独的网络诈骗罪罪名,也缺乏相关的司法解释和单行法规。第三部分,主要论述的司法实践中处理网络诈骗犯罪遇到的问题:立案管辖权的争议、电子证据取证困难等。由于缺乏具体明确的法律规定,使得我国在打击网络诈骗犯罪实际操作过程中面临重重困难。文章最后针对网络诈骗立法滞后和司法实践中存在的问题,提出一些笔者的建议:在《刑法》中增设网络诈骗罪单独罪名,完善相关的司法解释或者制单行法规;加大网络技术改造,提高犯罪分子的犯罪成本;国内国际警务加强合作交流,构建全球法网;加大网民安全防范宣传,注重网民思想道德教育,倡导良好的网络文化,营造良好的网络环境等。
[Abstract]:With the rapid development of social economy, the crime of network fraud also presents an upward trend, and becomes one of the most important problems in the network crime. Make clear the concept, characteristics, forms of network fraud crime, deeply understand the legislative status of network fraud crime, as well as the problems existing in judicial practice, explore the various effective countermeasures to prevent and control network fraud crime, This plays an important role in perfecting the criminal legislation of cyber fraud crime in our country and in combating the judicial practice of cyber fraud crime. It is also of great significance in safeguarding the property security of the vast number of netizens and maintaining a good network order. In addition to the introduction and conclusion, the article is divided into four parts: the first part, from the perspective of criminology, discusses the definition of the crime of cyber fraud, that is, to make use of the Internet to make up facts or to conceal the truth for the purpose of illegal possession. On the basis of explaining the concept of network fraud crime, the behavior of deceiving large amount of public and private property, seriously endangering the society, also analyzes the characteristics of network fraud: cross-temporal and spatial nature, strong secrecy, showing the trend of industrialization. Analysis of the causes of network fraud and typical forms of expression. The second part mainly combs the current legislative situation of the crime of network fraud, clarifies that the provisions of the Criminal Law of our country to combat computer crime have the initial system, but the stipulation is too general and broad, and there is no separate crime of network fraud. There is also a lack of relevant judicial interpretation and separate legislation. The third part, mainly discusses the judicial practice to deal with the problems encountered in the crime of cyber fraud: the dispute of jurisdiction to file a case, the difficulty of obtaining evidence by electronic evidence, and so on. Due to the lack of specific and clear legal provisions, our country faces many difficulties in the practical operation of combating cyber fraud crime. Finally, aiming at the problems existing in the legislation of network fraud and the judicial practice, the author puts forward some suggestions: to add the crime of network fraud to the criminal law and to perfect the relevant judicial interpretation or special laws and regulations; We should strengthen the transformation of network technology and increase the criminal cost of criminals, strengthen the cooperation and exchange of domestic and international police, and build a global legal network; We should pay more attention to the ideological and moral education of netizens, advocate a good network culture and create a good network environment.
