醉驾中交通肇事罪与以危险方法危害公共安全罪的界分

【摘要】：正【裁判要旨】醉酒驾驶造成重大人员伤亡的案件中,区分交通肇事罪与以危险方法危害公共安全罪的关键点是二罪名的主观方面:交通肇事罪的主观方面是过失,以危险方法危害公共安全罪的主观方面是故意。在醉驾造成重大伤亡案件中,判断行为人的主观罪过应重点考察事故是否属于一次性撞击、行为人是否采取紧急制动措施和是否在繁华人多路段高速行驶等关键因素,还要结合行为人驾驶技能、醉驾程度等辅助性因素进行综合判定。
[Abstract]:In cases where drunk driving results in heavy casualties, the key point to distinguish the crime of causing traffic accidents from the crime of endangering public safety by dangerous means is the subjective aspect of the two charges: the subjective aspect of the crime of causing traffic accidents is negligence. The subjective aspect of the crime of endangering public safety by dangerous means is intentional. In the case of heavy casualties caused by drunk driving, the judgment of the subjective crime of the perpetrator should focus on whether the accident belongs to a one-off impact, whether the perpetrator has taken emergency braking measures and whether to drive at high speed in a busy road section, and so on. Also combined with the actor driving skills, drunk driving degree and other auxiliary factors to carry on the comprehensive judgment.
